  • CCA Request letter

    Hi,

    I am new to the site and was given the details by a friend who has told me the members are extremely helpful. I had a credit card with MBNA which I haven't paid anything towards due to financial difficulty. The account was transferred to Arrow Global on 20/12/2011 and with the notification it states the original agreement dates from 28/01/2003. I have now had a letter from Shoosmiths LLP advising me that they are managing the account and any correspondence should be directed to them. My friend has told me to send a prove it letter along with a £1 PO I have looked on your site and can't see the template, could anyone help me at all?

      Can you recall the last time you paid into the account, or personally acknowledged the alleged debt in writing?

        Thankyou for your replies, I'm not sure the last time I acknowledged or paid anything but it must be 4 or 5 plus years ago. Who shall I send the letter to as The letter I received said everything should be directed to Shoosmiths.

          IMHO

          I would send the CCA request to Arrow, as they purport to be the new owner; copy/advise Shoosmiths under separate cover.

          Don't forget the £1 PO (Arrow only) & get proof of postage.

            Hi,

            Please can someone help me.

            I have finally had a reply from Arrow letter dated 20.07.2016 bearing in mind I have a Royal Mail tracking signature for 11th May 2016 for my CCA request.

            They have sent me one sheet of paper which appears to be the original agreement which is unreadable, a statement dated 13/07/10 which was my last payment and a letter telling me to direct my enquiries to Shoosmiths.

            I will try to upload pictures (with personal details covered) any advice will be greatly appreciated.

                    I can't read the document (application form) because it's totally illegible and has been heavily redacted.

                    Could this debt be borderline statute barred if your last payment was on 13th July 2010? That's six years ago this month. Did you make any payments after that date through a DMP or anything?

                    Sometimes the date of the DN becomes relevant which could be 3 - 6 months after the last contractual payment (or even longer with MBNA) unless you had already been defaulted and this July 2010 payment was a token payment or you were on an ATP.

                    Think back to what happened and when with payments.

                    According to you a claim has not been issued yet

                      Hi,

                      Thank you for your response. The last payment to MBNA was a token payment of £1 6 years ago. I was involved with stepchange and the last payment through them was December 2012, these payments do not show on my credit file. I'm not sure what to do next and if anyone could advise me it will be greatly appreciated.

                        In my opinion No the document Must be easily legible in ALL parts.
                        It can be rejected as non compliant.

                              Your Ref: as on their letter:


                              Sir/ Madam,

                              I am in receipt of your letter dated............................... in reply to my request for a copy of the agreement relating to an alleged debt for £xxx.xx arising from an account with name original creditor.

                              I am sure that both Shoosmiths and your client are fully aware that the document provided does not meet the requirements of my request made under the provisions of section 77/78/79 of CCA 1974 and I therefore formally reject the document and the alleged debt remains unenforceable.

                              Yours etc.
