Cca request has been replied to.
card application form 1999. Was a general mailshot form to me in married name. I filled in and marked form asking if i could have in maiden name.
I list x2 cc balances and have written to be transferred.
My signature. Ref code ni*99???7/??a31099. (?=illegible).
reverse is blurb about platinum plus card 4.9% bal trans. 15.9% purchase.
then down right column illegible are 2 boxes refer to financial and related conditions and if lose card. Under that 'set out in paragraphs 1 to 12 below......' blurred illegible but outline how funds allocated.
    ref code La1099 3107 (poss a 2) N.

Also inc. Was statements just for 2012 april when started to miss payment.. through to sept 2012 when account zeroed. Presume sold.
interesting their cover letter is 2.5k more than card balance.

    Thoughts please. Worth fighting?
    Thx in advance.

              Hi nemisis45.
They responded to my request for info. I have 10days to make proposal for payment.
they have included what appears to be front and back page of application form (terrible quality copy). Plus statesment just for period when i started to default and then acc sold on.
              wondered if worth fighting?

Fyi they did start court action in dec last year but withdrew (reserving right to re submit) when i complained as i had sent cca request so said they shouldnt have commenced action.

              Thx.

Making a CCA request does not prevent the issue of a claim.

                  Hi nem
i know it doesnt. But i stated they asked me to respond in a time frame and as they commenced proceedings before expiry felt they had acted inappropriately especially as i had responded.
I will try to get a scanned copy tomorrow and post up in evening.
They just sent copy application form and rear side with benefits of card large print and t&c ib small print. Plus statements just period of default.
Should they have sent me anything else under a cca request?
                  Thx

                      Hi charity.
the t&c were on 2nd (reverse) page in small print which copy has made illegible down righthand side... what could decipher was about how balance would be paid off / funds allocated. Main print was % rate for platinum card bal transfer and or purchases etc.
1st pg was completed application form.
                      thx

Were there any variations to T&C's during the agreement? (apart from interest rates)

I really cant remember. Not sure what they would amend other than rates.
Had card so long. Think only changes would have been % deals as or when i cleared it or added/transferred new balances over from other cards during its lifetime.
                          Thx

If an application form has been produced and it is claimed to be a copy of an agreement ( reconstituted copy) it should have the terms and conditions as relevant at the opening and closure of the account.

                              Re: Pra and mbna

have attached APPLICATION FORM which was on one side.
then i have attached the T&C which was on other side, but right hand column was unreadable so tried to 'blow up' hence why now onto 2 pages.

they also sent statements just for the last 6 months of the account when i started to default through to when it was 'zeroed'
these statements have the full t&c on the reverse as per the normal style.

there were no other documents, no confirmation of assignment or annual statement of balance outstanding. [although there cover letter has increased the balance by 2k]
this card was used initially for transfers, then was cleared then other balances transferred onto it - and i am sure that these transfers were in response to different offers given, ie 0% 12 months. so i am thinking that there should be other proof of different interest rates?

                              thanks.
