  • Robinson Way coming after me for a Santander Debt from 2010, what are my options?

    Hi all,

    Been doing some reading on this forum before i posted anything. Some great advice and outcomes due to the help offered!

    So my situation;

    Went overdrawn in 2010 after a horrible breakup and needing the extra money to find somewhere to rent. This never got sorted, and initially i buried my head . All bills and info were going to an address i did not live at since.

    So this week they tracked me down (6 years-ish later) in my houseshare. The letter roughly says;

    Due toHPH2 LTD (EX SANTANDER UK PLC) , Amount due £1827.35. They offer a few ways to pay in installments and are asking for a response by the 20th April.

    From what I have been reading (especially on this interesting thread), the debt becomes statute barred this year? It could be a few months though.

    So do i send them a CCA with the £1 PO attached and see what happens from there?

    Any help would be greatly appreciated. Its amazing to see the amount of help being offered here. Its kept me awake many nights over the years, and impacted on my anxiety issues

    Is it just a tracing letter you've received and not a court claim?? Can you post up a redacted copy of it (or email it to me and I will)??

      Hi [MENTION=49370]Kati[/MENTION], thanks for the response. It is not a court claim, no. Please see attached (the initial letter i got when i was away saying they have found my new address, and the second is the letter i mentioned in my first post).

        I just checked my Noddle file. 4/5 and 620 score. No CCJs or anything bad. I can see Robinson Way did a search on the 7th April though.

          It looks (to me at least) as if the first was just a :fish2: exercise. They've now found you, but they're not threatening court action as yet so it's not bad - and you could possibly get it to SB'd by making them "work" a bit
          How long is it since you stopped paying/acknowledging the debt?
          Debt is like any other trap, easy enough to get into, but hard enough to get out of.

          It doesn't matter where your journey begins, so long as you begin it...

            I never paid anything back, or acknowledged it. So probably around 2010 when I stopped using the account.

              What is the debt and how much is owed?
              Are you aware of any debt?
              If it's not on your credit file now under another company name (other than Hoist) or the original creditor it May mean more than 6 years has elapsed since the default date.
              It would be worth taking a free trial with Experian or Equifax to see if it appears there as Call Credit / Noddle is not used by all creditors.

              I think a prove it letter is the first approach.
              e.g.
              Date>
              Dear Robinson Way,

              Ref: use the one on their letter.

              I refer to your letter dated ................... in which it is alleged that I am indebted to Robinson Way's parent company HPH2 in regard to a debt originating from an account with Satander.

              Please take note I do not acknowledge any debt to HPH2 and have checked my credit files and can find no reference to any such debt.

              I require Robinson Way to provide me full details of the alleged debt including but not limited to a notice of assignment from Santander to HPH2 and HPH2 to Robinson Way, and I also require unequivocal proof that I have any liability whatsoever to HPH2.

              I expect and require a prompt response.

              Yours etc.

              Send by signed for post, check delivery date and signature.

                • The debt is for a default overdraft
                • I am not aware of any other debts
                • The default was for £1827
                • After checking with Equifax, it seems the default date is July 2012 and was by Hoist Portfolio. Thats the only blip on my record


                I have attached a screenshot of that part of my report.

                So the default date is much later than I had firs thought Should i still send them a CCA?

                      Could they have defaulted it overly late?? If you are sure you haven't paid anything towards or acknowledged the debt since 2010 then it should have an earlier default date IMO :noidea:

                        Hmm, I could have my dates mixed up, but I was pretty sure all this was going on in late 2010, or 2011 at the very latest. It was around the end of 2010 when i had the problems. Maybe Santander let my account carry on for a good year after that though?

                          It might be worth sending a SAR request to Santander to see if they have details of when your last payment was :nod:

                              SAR's aren't so bad It wouldn't acknowledge the debt (and gets a lot of info at the same time) xx
