  • Change of claimant before court?

    Hi everyone

    Just a bit of advice please for a friend.

    There seems to be a theme here with MBNA - claimant not providing documents to defendant (CPR 31.14) - they allow the case to be stayed and then they provide some documents and kill two birds with one stone - by applying for the defence to be struck out (as it is non compliance with CPR 31.14) and an interim charging order (which the claimant knows nothing about!)

    The claimant has set a court date for a final charging order hearing in July this year but in the meantime he has received notification that they have sold the debt on.

    Can they commence with proceedings for the final charging order? - if the claimant is now a different company ?
