    Good Morning All,

    I have search the net and LB for this topic but I can't see anyone who's been in this position oddly!

    Back at the start of this year I signed a vehicle order form with a lease broker, the 14 day cooling off period has now elapsed.
    I have not yet signed the Finance Agreement with the funder / supplying dealer as it took them a month to get it to me after it wasn't correct in the first instance and lots of chasing.
    However I'm now in a position where I do not want to go ahead with the car as it's utterly frustrated me with their incompetence and lack of willingness with me, the customer & I'm concerned should something happen during the contract term they will be of no use.

    After looking on Nationwide Vehicle Contracts, Lingcars and a few other brokers a lot of them state that:
    • There is no binding agreement between you and BROKER until a valid finance agreement is in existence, and BROKER has received all correct documentation.


    Lings also state:
    If you have changed your mind:
    If you have simply changed your mind about your order you should inform me in writing/fax/email as soon as possible. Unless you have signed finance documents and exceeded cooling-off period, I should be able to unwind order. However, there may be a charge for doing so if costs have been incurred by supplier. If you are outside cooling-off period, you must deal with finance company who underwrite your car/van.



    Can I legally walk away? I appreciate they will withhold Admin Fee and deposit - I'm ok with that - it's bearable.

    Well, I could'nt see any reason why you can't as you have not signed anything but also depends on what the order form states too. You will need to do it quickly before they get the amendments changed but thye may want to charge you for the usage since you have had it.

      Thanks for the reply,

      Just to confirm I do not yet have the vehicle and as far as I'm aware it hasn't been registered either.

      Other than the usual spiel it just say's if I fail to enter into a finance agreement with the find I'll have to finance myself through alternative means but I doubt the funder / dealer would allow or enforce that?

        If the finance has not been agreed the contract hasn't been completed and hence there is no enforceable agreement.

        IMO (for what it's worth!) they can retain the admin fee, but should return the deposit.
