  • M&S Personal Reserve - Query CCA1974 & Increase In Debt

    Hi wonder if someone could give me some advice
    Took out a M&S Personal Reserve in 2000 - financial problems in 2002 and due to low income have been paying M&S very low monthly sum since then

    Did a CCA & SAR some time ago - just got back almost illegible copy of application form/T&Cs - I recently missed a couple of payments due to illness so decided to write to M&S with a new CCA request explaining that previous docs were illegible and that copy T&Cs did not correspond with the application T&Cs.

    Have now had letter with just reconstituted T&Cs dated 1998
    M&S say they had complied with s78 & & with Reg 3(2)(b) of CC(Cancellation Notices and Copies of Docs Regs 1983 as they have provided a copy of the agreement I signed and that it is enforceable

    The copy of the agreement is the almost illegible application form/T&Cs
    but I can make out that there are some differences in the reconstituted T&Cs to the original T&Cs

    Not sure how to progres on this - I also want to query amount claimed as owing but thought this post was already too long & not too sure if I have explained it all clearly Thanks!
