Re: MCOL Defence Now Lapsed 31 Days

    IMHO

The etiquette seems to be to write to the claimant (or their legal bod if 'represented'), inviting them to withdraw the claim in the interests of justice & to reduce further wastage of court time & costs.

I believe Charity is suggesting that you write to the claimants/solicitors asking them to withdraw the claim or you will be forced to apply for a strike-out at their cost (am I right C??)

                  Hi All

I received a letter from the solictors (Mortimer & Clarkes) about 5-6 months ago stating they will not be persuing this claim anymore and its now closed on their records, HOWEVER yesterday 03.11.16 i received a letter from the original debt collector ( DHC ) stating that the monies needs to be paid attached is the original agreement of the Hire Purchase (which is correct and is attached) and the fee of £295 is still outstanding....

Now originally they filed a CCJ against me for £295 too which they have attached a made up summary of payments page stating the £295 fee is for solicitors fees ???

                  Whatever else....

Can anyone please advse me on what to do next as i was going to ignore this letter as ive received a STAYED from the courts why dont they just leave it there...

                  Kind Regards

Is the original claim still stayed? You need to check with the court again today.

This £295.00 is their cost and nothing else?

Can you please post a copy of the HP agreements after removing personal details.

                      Hi nem
The £295 is the orignal outstanding fee which they have tried pursuing me for, the letter i received yesterday maybe the respnse to the CPR as it has the original High Purchase agreement attached, and just spoke to the court and they have stated that its Discontinued and that they would need too apply via a judge/courts again to pursue the monies...

As for copy of HP agreement i cannot upload this until later on tonight or tomorrow ?

                      Kind regards Howie

Ok they are trying to recover the original court/solicitor fee's from a discontinued claim?
Let's wait to see the agreement.
