  • London parking solutions PCN HELP!!! 3/4 won 1/4 undecided.

    Hello, I am looking for some advice regarding London Parking Solutions. The management agent of my block of flats has recently sub-contracted this company to manage the parking at the back of the flats and today I've popped back to my old address (where post still goes) to find 3 x PCN from them.

    Firstly, I never had anything on my car, and the charges are for 3 consecutive days in a row. Second, the price has apparently gone up to £78 because I did not respond to the ticket! Well I've never had a ticket to respond to! Thirdly, when I log in on line to view this supposed breach of parking in a permitted area, the charge had gone up further for each one to £100!!!

    The photos they took of my car are grainy at best and hardly incriminate my car as being in said area. They have taken a close up of the sign but then when they take a picture of my car, the sign is just a blur on the wall. They have also not taken a picture of the ticket stuck to my car so have no proof that they issued it in the first place.

    I have also received a notice to keeper within 28 days (actually it came 10 days after the supposed tickets were issued) - am I right in thinking this was a breach of the keeper liability act 2012?

    This company seem flaky as anything, and I am looking for the best way to appeal. The situation with the parking has been a massive issue as the flats were rented with access to parking albeit not allocated and then taken away about about 4 months ago. People continued to park there until these signs went up (from LPS) and then as soon as people started getting tickets, I stopped parking there. The photos they have taken are also not time/date stamped so could have been taken any time!

    Any help appreciated!!!

      Some information please. Date of the "offence" and the date on the letter. No windscreen ticket then must be within 14 days.

      Have you got your lease out to see what it actually says about parking? Would help if you could post up one of the notices, suitably redacted, so that people can see what they are claiming.

      How were the parking conditions varied?

        Can you post up a suitably sanitised version of this ? It appears they are relying on a notice to driver which should be followed up in AT LEAST 28 days with a notice to keeper.

          The alleged 'offences' took place on 12th, 13th, 14th January, I will try and work out how to upload an attachment as I've taken a photo of one of the letters.

          The parking is not written into the lease, and was verbally confirmed to just about everyone I speak to in the flats but not on paper. I knew this when I signed up but did not expect them to then take the parking away! Anyway that's something I've excepted and had to deal with. Since they've put up the signage from LPS and started ticketing people I stopped parking there, but they've obviously caught me in this in between. However, I have never had a single ticket on my car so want to appeal on those grounds as well as all the other things I summaries above (no date/time stamp on pictures, pictures are very grainy and not clear etc)

          Does anyone know how to upload a document/image to a thread?!

                All tickets were the same ? NTK after 10 days ?

                  Yes all tickets were the same, all sent out on the same date. I will appeal as above - out of curiosity what is the reason that it is flawed?

                    For starters, they issued a notice to driver (put a ticket on the vehicle) and so have to wait 28 days to apply for the registered keeper details. Having done so beforehand this invalidates any notice to keeper which they cannot rely on the statutory provisions which enable them to chase the keeper if they do not know who the driver is.. I'll read through further when required as the period of parking is usually not stated correctly etc

                        @mystery1 mystery !!!!!!! can you please have a look at my POPLA saga. I am at the stage where the MET has sent their evidence in response to my appeal. But I have a feeling there is still a way to a strong counter. I have 7 days to comment! well 6 now. PLEASE HELP, im your number 1 fan!

                        Can i email their evidence to you?

                            Not sure what the options are but do so as registered keeper only.

                              Hi there, I've received 3 x replies regarding the tickets. All rejections as expected...how do I post a picture of them up for you too see? Two letters are the same, and one is different, not sure why?!
