Voluntary Termination

Hi ,
I am currently thinking about handing back my car to Black Horse through Voluntary Termination, as although my payments are up to date and made on time due a change in circumstances to my finances I will struggle to make further payments and have been looking at the forum for advice which has been very helpful.
My query is a long shot but thought would seek your advice. On looking through the paperwork my HP agreement is for a Mazda 3 2010 1.6 PETROL car however my car is Mazda 3 1.6 DIESEL and is registered as such with the DVLA would I have any case against Black Horse if there are any issues re VT?

No you shouldn't, as there is a clear error and mistake which was not raised by either of you and have continued to make payments on the same terms, which would not have been any different. If they refuse to VT on that basis then you argue that the contract is void anyway. so it doesn't matter either way.
