    Good morning I was in process of checking this small claims form and taking a trip to PO to mail it off... then I look on reverse and it goes on about Hearing Venue..Witnesses...and dates not available. Is there anyone around who can help me fill the form in please.???
    I can not be pinned down to certain days as such my job for a hospice means often I don't get my hours for the week until a few days before.. the only day that is certain is Sundays...
    Ive attached a thumbnail of the flip side of the form but to be honest I'm too scared to fill any of it on my own.. so would appreciate help and guidance.... please

          Hell Pancho.

          1. Venue the nearest County Court Hearing Centre to your home. If you don't know you can leave it blank.
          2. Yes to Small Claims.

          3. No expert witnesses.

          4. Dates: in your situation with work it would best I think to say only dates that you definitely know you cannot attend. No Courts Sat/Sun anyway .
          I think you will have to get a date and ask specifically for time off. You need to attend to prevent the claimant from having a " free run " in court.

          5. No interpreter needed.

            Its really scarey... These people never sent me the documents I requested in my defence and apparently they don't have a license. So despite all this people still have to fill in these forms?
            Just to clarify on section A1 - "do I agree to this being referred to small claims mediation" I tick "yes"

                Correct yes to small claims track Pancho.

                The claimant is covered by the parent companies license.

                            Its all very much appreciated your help. I read a couple of posts on here and from what I can gather this is all letters... small claims..mediation etc is pretty usual in these kind of situations and it rarely goes to court

                              Many claims just get stayed some are withdrawn/ discontinued, others are settled or partially settled out of court, then some are settled by means of a consent order agreed between the parties ( by mediation) then those that get to trial are in the hands of a judge to decide what in the balance of probabilities is the right decision.

                                Good Morning everyone... thankyou for all your help.

                                I try to read other posters/threads on here to get some insight.. and to try to learn. I got to admit it is all mind boggling and I end up having more questions :0)

                                Anyway - I know you are all real busy and any feedback you guys give is appreciated very much.

                                I have mailed recorded delivery the "mediation/small claims" letter from court.

                                Hoist never came back to me with the copies I requested way back when all this started - the agreement, default notice and notice of assignment... yet they are going through the small claims track??

                                Also having read a couple of threads on here... I am thinking/wondering that I may well get a call from mediation??? My question is this - on the off chance that this may be the case - how should I prepare for that call? I read a thread where the person in question basically said to the lady who was mediating that "they never received copy of agreement... default notice and notice of assignment and therefore cannot defend the claim" - would this be the right thing to say on the off chance that I am contacted by mediation?

                                Have I waffled? Goodness - I do I must admit. Anyway if you can understand what I am trying to say and respond I will be very grateful ;0)
