  • D(A child) Re (No 3)

    http://www.bailii.org/ew/cases/EWFC/HCJ/2016/1.html

I have kinda followed this case last year because a couple with Learning difficulties was denied legal aid because the father's part time job meant that he was about £90.00 over the legal threshold for legal aid. However, this case was the final appeal against a placement order for the child of parents with Learning difficulties.
Ultimately Lord Justice Mumby made the difficult decision to place the child for adoption but there were many aspects to the case that were of interest such as cultural differences and different parenting styles plus the issue of the guidance that social workers should abide by when dealing with children who are born to parents with learning difficulties.

This really really annoyed me tonight. I read the Daily Mail's version of this. The basics are there but the Headline says: "Four year old will be taken away from parents with learning difficulties because social worker's say he's not getting enough cuddles" then shortly afterwards: "The boys parents, both from Swindon have Learning Disabilities"

There is a ****ing difference between Learning difficulties and Learning disabilities. Really annoyed me tonight reading that bit.....

Just been helping someone looking for a case on BAILII and came across this case where the appendix relating to dealing with parents with learning disabilities is in the appendix
