  • Lowells trying to collect on current account overdraft

    Hi folks - Lowells purchased a couple of old debts last summer and have been sending begging letters ever since. One is a pre-2007 loan, on which I have followed the CCA request guidelines. The other is from an overdrawn current account, overdraft circa £900 plus fees circa £500 for a ~ £1400 claim. They have gone cold on communication from the loan account after the CCA request, but they are getting 'hotter' on the overdraft account and I am now in "pre legal assessment".

    From what I understand this can't be defended in the same way as a pre-2007 CCA agreement - is there any advice or guidelines on how to defend?

          Correct, but my opinion is should this go to litigation and a agreement is mentioned in the particulars of claim, it must
          be provided to support the claim.
