      When you say ' I must file a defence within the next 7 days' in your first post that must be on an order from the court - I think you did say you had a N24. Could you scan in/photo or type out that order word for word please. ( leave out personal details)


      The first course in 1997 - was that at the same level of study, and did you complete the course?

          Do you want me to upload more redacted documents? I have bundles, but they all seem directed to the claimant and not me. Also, when i wrote an email and phoned the court just before the latest letter, they said that they have not received any correspondence from the claimant. I just presumed we both turn up at court and give our version of events. However, the situation doesn't seem to be turning out that way, which is concerning me.

            No, i was not in a financial position to complete the course. I could not remember exactly how long i studied for previously, but in my recent loan application, I remember noting down, 1 year and 3 months of study. When, I later asked Kingston to confirm this they made enquiries and said i had only studied for 3 months. I also wrote an email to my previous Uni, who confirmed that i only studied for 3 months. This, later was a mistake and my initial duration of 1 yr and 3 months was correct. This, apparently could have been another reason why i was ineligible, but i wasn't ever formally informed

                Hi, Can anyone advise on a statement? What do i need to do? Can i email the court or do i have to hand the statement in? Any help would be appreciated because i have to hand this in by no later than Wednesday 11th Novemeber!!

                  I am confused. Do i have 14 days from the claim to write a defence (which i did incompetently) or do i have 14 days from the court date??!!!!!!!

                  I have written a quick statement. Not sure what i'm doing!!

                  Within the first 7 days of BSc Building Surveying course I approached Kingston University student advice centre.I explained that although I had been given verbal confirmation of a student loan, from the Student Loans Company, I still had not received any funds to enable me to continue on the course. An advisor at the University explained that I should have spoken to Kingston Student advice centre before because the University have internal contacts within the Student Loans Company and could therefore resolve any issues.
                  After explaining the full details of my situation to the advisor, who went out of the office and said she made some enquiries.The information was positive as she reassured me that my previous studies would not affect my loan application.

                  When I returned, in the New Year and after 3 months of study, my IT and library access was blocked.At this point, I was told by staff to kindly ask a colleague for their login information, so I could continue with the degree.However, this interrupted my course since I had no access to emails, course information and restriction on books.

                  In February, we received an internal message from the head of the Schooll of surveying that the University have decided to close the school and make 98% of all the staff redundant.I complained, attended several meetings.I was never informed of an internal complaints procedure.

                  At the end of year we had an exam, which I was not registered on

                  My coursework and first year results were confiscated and retracted which the OFT had already warned Kingston University.

                  Consequently, I was not only encouraged to continue with my studies I was re-assured that the University could deal with this problem.The constant encouragement and advice from staff enthused me to continue with the course.

                  The blocking of all University facilities prohibited my learning, communication and research on the course.

                  Closing down of the school and 98% redundancies.Impacted on quality of teaching and was the main reason why I chose Kingston University.The professor, who headed the department was a leading researcher and lecturer.

                  The withholding of my coursework and results ensured that the year was a waste of my time and money.

                  Please can anyone actually help? I have been to CAB and they just direct me to debt help! There's no legal aid. What do i do?!

                      The judge wants a statement of the facts from your view and the university's ( just like you would write if you witnessed an incident and had to make a statement to the police.

                          The judge wants the facts in order of the events as you see them.

                          Setting the parts out into number paragraphs double space between each one will please the judge for a start.

                          1. On date I applied for a loan from the SLC in the sum of to fund a course at Kingston University.

                          go on from there in chronological order.

                            It needs to be concise, it must be facts and not opinion and you need to number each point - we are talking about submitting a defence? Your documents refer to a witness statement being submitted.

                                Here's a better idea how to word things, you have made a good start with the facts It is really just formatting and dates. I'll give you the headings and statement of truth once you've completed it. I would like to see what defence you originally entered in the case please too.

                                1: I, xxxxxxxxxxxxxxxxxxxxxx, of xxx xxxxxxxxxx address xxxxxxxxxxxxxxxxxxxxx am the defendant and write this witness statement in support of my defence in this claim. I am a litigant in person.

                                2: On xxxxxxxxxxxxx I registered with Kingston Univeristy to take a BSc Building Surveying Course.

                                3. I applied for funding for this course through the Student Loan Company. My application was submitted on xxxxxxxxxxxxxxx.

                                4. On xxxxxxxxxx I received a telephone call from the Student Loan Company confirming I was eligible for funding and was free to commence my studies.

                                5. I commenced attending University on xxxxxxxxxxxxxxxx and started my studies.

                                6. On xxxxxxxxxxxxxxxxx I was concerned I had not yet received anything in writing, nor any payment, from the Student Loan Company and attended the Kingston University Student Advice Centre. At this point, I was told by staff to kindly ask a colleague for their login information, so I could continue with the degree.However, this interrupted my course since I had no access to emails, course information and restriction on books.

                                10. I made further enquiries to the Student Loan company ???????????

                                11. On or around xxxxxxxx February I received n internal message from the head of the School of surveying that the University have decided to close the school and make 98% of all the staff redundant.I complained, attended several meetings.I was never informed of an internal complaints procedure.

                                12. I managed to continue my studies until July? xxxx when there was a compulsory exam. I attended the exam to discover I was not registered to take the exam...............

                                13. My coursework and first year results were confiscated and retracted ?? by the University.

                                14. I am aware now that the Office of Fair Trading had already warned Kingston University. ( DO YOU HAVE THIS ? IF SO INCLUDE IT AS AN EXHIBIT )

                                15. Consequently, I was not only encouraged to continue with my studies I was re-assured that the University could deal with this problem.The constant encouragement and advice from staff enthused me to continue with the course.

                                16. The blocking of all University facilities prohibited my learning, communication and research on the course.

                                Then why you do not feel you are liable to make payment to Kingston Uni for the course. Add in had you been aware that your loan had been turned down by SLC you could have made alternative arrangements or attended another college when things kicked off, to continue studies, however Kingston led you to believe everything was in order and you felt as your course had been paid for by the loan you should continue at Kingston. At no point were you informed you would be liable directly to Kingston. Had you been aware you would have left and claimed a refund from them - that kind of thing.
