    Hi when I submit my defence what happens then do I have to keep logging into MCOL to check the status? Lowell hasn't come up with the CCA in the time they have allocated either

          Hi,

          Once you have submitted your defence the court will pass a copy to the claimant who then has 28 days to respond, if
          the claimant fails to respond the court will stay the claim.
          If you don't hear from the court or the claimant by the end of the 28 days check with the court in regard to the status of the claim.

          You will Not be informed if the claim is stayed .

              A stay holds the claim in abeyance, the court takes this action if there has been no reply to your defence, the claimant
              then will have to apply to lift the stay to continue the claim.

              There is no notification that this has happened, hence the need to check with the court
              if you have not been contacted by the end of the 28 days.

                Hi guys I wonder if any of you can help me, the court received my defense on 6th November 2015 and I still haven't heard anything, do I have to contact the court? It's now 13th January 2016 does this mean they can't continue with the claim I'm very confused 😢

                  Hi again I rang the court today and they said that the court has stayed the claim on the 10th Dec as they took too long to reply to my defence would any of you know what may happen next?

                    stays stayed indefinitely unless they apply to court to have it lifted and continued, longer they take to do that if ever the better as they would no doubt need a good excuse to take so long to action!

                          I received a county court letter asking for my financial details for a debt from 2012. I was incapacitated and registered disabled for most of 2013 and once back on my feet I attempted to contact that creditor and they said someone else was dealing with it and they couldn't help. I never heard anything. Now I have this letter and I'm worried. I'm barely scrapping through on my wages as I can't do much overtime due to illness. Is this a genuine ccj letter or are they trying to intimidate me? Cause it's working. They keep defaulting my credit file and they are asking for £1000 MORE than the debt was actually worth

                            Hi guys hope you are all well I want to thank you for all your help with the last problem I had.
                            Today I received a CCJ claim form as before but this time I'm pretty sure it's older than 6 years old this debt, can they still send me this even if it is past the 6 years? shall I just go ahead and so what I did before which was acknowledge the claim and then send a CCA request and then would that tell me if it is over 6 years old? also if it is can they go any further? thanks for your help and look forward to your reply 😁

                              give peepes more detail as to the claim who/for what? you can state over 6 years old (Statute Barred) at a later stage, also get a SAR off the the originator would be useful to show last payments / acknowledgment etc

                                Hi Mike, thanks here is the info on what I have it's a claim for CCJ and the claimant is Capquest and the address for sending documents and payments is Drydens Limited. the total amount of the claim is £683.12 and it's for a 'Shop Direct' account which I haven't had since I lived in my last house and I've been in my new house for nearly 6 years already so I'm sure it's past 6 years
