      Thank you for your advice, Debt camel.

      I have contacted the fca helpline and spoke to a gentleman who said that Rundles no longer have permission to carry out any activity with regards to pursuing debts from any individual as at 30 June 2015. The man i spoke to said he was going to escalate the matter to the unauthorised activity team for further consideration and action.

      So it seems that the bailiff from rundles had no right to come to my home on last Friday.

      I wonder if it would be a good idea to make a complaint to Rundles & Co about the bailiff visit.

      What do you think?

          Once a warrant is issued an enforcement agent can only enforce that debt using the procedures outlined in Schedule 12 of the Tribunal Courts & Enforcement Act.

          It is important to stress that there is actually no requirement on the enforcement company to hold a Consumer Credit Licence if they are enforcing warrants of control.

          Some enforcement companies do hold such a licence and the reason for this is purely because these companies also undertake regulated debt collection. For example, they may be undertaking debt collection work on behalf of private parking companies.

            Right, a quick update:

            I have just received feedback from Rundle & Co answering my earlier query.

            Their email states: " I confirm that we attended the address on the instructions given from London Borough of Sutton Council."

            Any thoughts, anyone?

              Hi all,

              I have today received a call from the council who left a message on my answermachine.

              I have returned the call and spoke to a lady who told me that the council did not give Rundle instructions to attend my address. She also apologised and give Rundle instructions not to return to my address. I have asked her to put this in writing and she agreed to do so.

              Here's where my problem comes in: There are now two conflicting versions concerning the issue of whether or not the council gave Rundle & Co instructions to attend at my address.

              Should I proceed with a complaint against Rundle? Or should I continue with my complaint against the council?

              Any advice would be highly appreciated.

                Complain about both as in muppetry galore, Bumbles & Co would not have attended without the council sending them ,so council & Rundles need a kicking.

                    Send a complaint to the Organ Grinder (council) as well as the monkey, the council are ultimately responsible as it is their feck up that sent the bailiff out to you in the first place, copy complaint to Council CEO, Elected Leader Local member and MP to keep them in the loop.

                      Here's an update on this matter.

                      I submitted my complaint to both the council and the bailiff company and here are the results.

                      The council's response:

                      The council's council tax dept confirmed receipt of my letter dated 13 February 2013 which informed them that the debtor was not residing at my address and this was attached on their system.

                      The Council further said as follows: "Several attempts had been made by enforcement agencies to collect Ms X's outstanding council tax arrears, but once we realised that she may no longer be in the borough the debt was transferred to an enforcement agency which is used when debtors require to be traced. This organisation (Rundles) had been tasked with exploring every avenue to trace Ms X and pursue her for the debt and this would involve visiting all known addressess to see if she has retained any links there. Your address would have been on the list as one of her previous addresses and for completeness the enforcement agent would visit as part of their enquiries."

                      Now here is what the Bailiff company has said in response to my complaint:

                      " Dear Mr xxxx Thank you for your email, of which we have noted to the account in question.
                      We received instructions from our client London Borough of xxx on 5 June 2015 to collect an outstanding balance owed to them. On 8th June 2015 a Notice of Enforcement was sent to yyy. We can confirm that we have checked our records and this is the address that our client provided us with. As we did not receive any contact, a Further Notice letter was sent on the 23rd June 2015, this advised that the case would move to enforcement in 7 days time, should resolution not be met by then. (incidently, this letter advised no such thing) Our enforcement agent attended the property on 21st August 2015 and under the current regulations, he attended at the relevant premises, as it was the address given on the courts liability order dated 7th September 2010. You advised him that this was no longer a current address for Miss X, with this new information he acted accordingly and advised our office to remove your address, which we actioned immediately. Please accept our apologies for any inconvenience caused to you."

                      I have referred the matter to the Local Government Ombudsman, however, they sent me a draft decision in which they stated that they do not intend to investigate as there is "no evidence of fault".

                      Does anyone have any comments, ideas or advice on the above, I would appreciate it.

                          no evidence of fault??

                          The council KNEW that the debtor was not living at your address but still gave it to the bailiffs! Have you put in a formal complaint to the CEO of the council (instead of one of his minions)? You could try getting your MP involved ... I've found that things seem to go faster if you get them on your side (and go straight to the top) :nod:

                            Hi Kati, thanks for your reply.

                            Yes I did submit my complaint to the CEO and he counter signed the council's response.

                            I'll try getting my MP involved. I was however pondering on the thought of taking this matter to court, but I am unsure if that would help.
