I recently bought a flat and moved in 10 days later. I noticed clear No Parking without a valid permit signs. I had not been informed how to obtain a permit and there was no information on the signage on how to do this. I received a parking ticket from London Parking Solutions that day as I was moving furniture into the flat from my van. I was given the phone number of the managing agents of the flat and called them. They had not been informed by solicitors of my acquisition of the property so were unable to issue me with a permit. They told me that my van would be exempted from parking tickets until I could be issued with a permit. I appealed against the ticket but was rejected on the grounds that I did not clearly display a valid parking permit as per the warning signs.
I am reluctant to waste time with an appeal to IAS as I've heard they're not as independent as they should be and publish no details of appeal outcomes. My instinct is to ignore further invoices and wait for the Letter Before County Court Claim and then fight them there. Would I have a case on the grounds of unfair contract since, as I am entitled to park there, they have incurred no financial losses??? Or is this irrelevant since my parking permit is free?

As you bought your flat did you also buy a parking space? Your deeds should say. If you can get a copy of your deeds then that would be very helpful.

The parking companies can only work with permission of the landholder. As you could own the land did you give them permission to put a ticket on your vehicle?

I've just noticed that you have 2 threads running on the same subject. Suggest you delete 1 so that all the advice is kept together.

In your other thread you say that your permit is free. This could be because they know that you own the land and to charge for doing something with your land is a no no.

Could you get a letter from the managing agents of the flats saying you are/were exempt due to not having had chance to get a permit?

Does your parking require a permit ? That is the key. The answer will be in your deeds.

Thanks for your response. I don't own the land only the flat. The right to park a car is not mentioned in the lease. I can obtain a second permit for a another car and there is a charge of £25 for that. The payment however is to the Managing Agents not LPS.

Thanks for your reply. The original lease states that "no vehicles shall be parked upon or in any other way permitted to obstruct the driveway in the Estate". I assume the driveway is the road which runs in and out of the Estate and on which we seem to be allowed to park now with a permit from the managing agent.

The question i'm asking is why you have a permit and how did you get it if there is no right to park ?

Why is the permit free ? What entitlement do you get from a permit ? Who is allowed a permit ? Did somebody just post out random permits to confuse people ?

I have said the original lease which is 25 years old states there is no parking. However since then parking has been allowed by residents after obtaining a parking permit from the managing agents. I don't know why the first permit is free. You are entitled to park without getting a parking charge notice from London Parking Solutions with a permit. Residents are allowed a permit. No, somebody did not post out random permits to confuse people, they post them out to residents who request them.
