    Urgent Advice Needed

    Hi there

    Hope everyone is okay

    I am in a little bit of a dilemma here and would appreciate any form of advice

    I love the job I do but it appears I am a victim of mismanagement (as stated by the union rep)

    I was coming in from my lunch break and was accosted by 2 children to resolve an issue but forgot to inform the manager because I was the alone left in charge of signing everyone out for the rest of the day. It was brought to the manager’s attention the next day and I was suspended for failing to tell the manager.

    Please note:
    there was no harm, threat or danger done to anyone and it was my intention to provide an update about the argument but as i mentioned earlier i was left alone to sign people out

    Whilst I know that I am not in the managers good books (for reasons I don’t know) I have not let it affect my work or have any form of confrontation despite things being brought to my attention.

    I attended a meeting with my union rep, wrote my statements and my colleagues have also written a few constructive things about the work I do. In addition to my job I am volunteering with a Montessori to complete my postgraduate degree.

    My current place of employment has temporarily closed down due to other management issues, cuts.. and my colleagues have been assigned to other roles within the council temporarily

    **My employment is a fixed term employment renewed every year and it’s from September to September but holidays start in July

    I received letters in the following order
    • Initial suspension Letter
    • Letter to a meeting
    • Letter informing me of a hearing (no dates)
    • Letter stating i have been assimilated and will be redeployed within the council renewing contract (letter given to all my colleagues too)...... my union rep says it was sent to prevent the council from looking prejudiced
    • A new letter stating my suspension has been extended till the conclusion of my hearing (no dates) and i should contact a new manager if i wanted more information.


    I have been suspended now for 6 weeks and no employee will know whats happening to where they will work till September because it’s term time holidays

    My Union Rep has said the following:

    • I am a victim of mismanagement because they need to show they are tough now
    • I have a 40/60 chance of keeping job despite my colleagues support


    I am really tired and is extremely frustrated at the entire process. Frankly speaking I didn't think it will get this far. I am considering resigning with immediate effect but I am a bit concerned about several issues:

    • Sending my resignation to the new manager listed in the current letter
    • Although the organisation is run by the council it is been temporarily shut down and we don’t know if it/when it will open
    • The possibility of my resignation being rejected
    • Concerned about references (i was redeployed there for 6mths but been with the council for 20mths............. previous organisation was closed down)
    • I don’t stand the chance of appeal because f my length of service
    • If I wait there is a possibility I may be dismissed because the allegation is gross misconduct i.e failing to inform the manager despite resolving the issue


    I am getting tired of waiting indefinitely not knowing what to do. I also need to clear my head, think positive finish my postgraduate course and start looking for a new job

    I will appreciate any advice

      Hi

      If you wish to resign then there is nothing stopping you from doing so. In relation to the reference legally they are obliged to give you a factual one so they might let potential employers know you are currently on suspension. Out of interest are you suspended on full pay??

      In all honesty I will start looking around and if something suitable comes up tender your resignation and make the potential employer aware of your current situation once they offer you a role.
