    Hi Guys,

    Help needed please?

    I have been sent over by Pepipoo, it's a long story but will keep it brief, I have a IVA being voted on Monday, EO turned up this morning 6am to remove the car, they have said they were removing it before but action was stopped (I thought) by my solicitors dealing with the IVA.

    Now here is where it gets interesting, the car was paid for by my father and I explained that to the EO but he was having none of it, although I am the RK I pay dad a certain amount of money per month, I gave the EO a signed letter from my dad which says he's the Legal Owner, I have bank statements showing car payments every month and a receipt showing he paid for it, plus his credit card receipt showing he paid for it.

    Anyway after a 5 hour stand off I let them take it, I informed the council and they said nothing they can do, anyone know of any case law etc. that say's a car cannot be removed if it belongs to someone else. I know EO hear this all the time but it is true I do not officially own the car.

    Oh they have also damaged the car bgy pulling it sideways off the drive, I recorded everything and as the car is a 4WD the power steering seemed to be broken.

    Was the receipt just on a piece of paper or proper invoice from garage? Otherwise he may need to submit a Third Party Claim for it but may have to deposit the value of the vehicle to the Court as surety.

      Hi Ploddertom,

      We have a photocopy of the invoice but I am going to provide them with an original invoice of sale, also is it worth me getting a statuary declaration signed to go with it?

        You only have just a few days to do this otherwise they could sell it. Best your father makes a 3rd Party Claim.

          They told me ten days, the new bill of sale has been put in the post by the garage and should be here Monday, will have to see what happens now
