  • Help with Lowell finacial

    Hi I need some advise about Lowell financial a few months ago my husband receive a letter saying he owed £705 to Lowell which had belonged to provident we ignored a few then decided to get them to prove it with the correct template and no signiture, after a few weeks they send a letter say they where having problem with receiving the information so had put his account on hold, then last week through the post was a letter saying they had enclosed a copy of the credit agreement it stated the loan was in October in 2008 the name on the top was mis spelt and my husband carnt imagine he would agreed to have his name spelt differently, the siginture does look like his tho, we then looked up his credit score and the amount had a default of December 2009. My question is do we agree to pay the amount back now and should it be done over phone or again in writing they have given 30days to sort it out.

    Are those details correct? Was the loan taken out in October 2008? Would be good if you could post up a copy of the document they've sent him (remove all personal details first). :typing:
    Any idea when he last made a payment? Defaults are often recorded long after you actually default.

    There's no rush, just because Lowell say 30 days it doesn't mean they have to be obeyed. :nono: Any dealings with them (or anyone else for that matter) should always be in writing, never over the phone. :typing:
    Let's see what documents they've got and if we could establish the last payment date it would help. :thumb:

      I've taken a picture with my iPad any clue how to include the documents bit stuck but it does say 29/10/2008 haven't a clue when the last payment was my husband said he carnt even remember the loan being done so is a possibility he might have only paid one or two instalments

        In that case, it could be statute barred. :grin: Some people have been successful in finding out the date of last payment by ringing the bank, it may be worth a try.

          Hi,
          Has Lowell threatened any court action ye?
          Does the misspelled name vary greatly from
          the correct one, or is for instance Clark but
          spelled Clarke?

          How much information has been provided with the " agreement"?.
          Most certainly Do Not make any offers by phone!!
          Provident paperwork was often faulty, especially
          with loans via their agents calling house to house,
          was this such a loan?
          Please let us see the agreement and all that was supplied
          with it before you do anything.

            They haven't threatened court action yet, his first name has one letter incorrect on Lowell letter and the agreement, it was agent her name is on the agreement form they have also sent a print out of copy of a annual statment/document viewer, I am trying to insert the documents but I am having trouble doing this

                        I'm pretty sure there should be more Terms & Conditions included with that as reading the signature
                        panel it states this page and the page overleaf.
                        This has not been provided it seems making the agreement non compliant
                        with the CCA request and it can be rejected on that point.

                            I am beginning to wonder if this is status barred as the original amount was 800 now it 705 if it was payed £15 a week then stopped which I carnt find evidence of it would take into jan of 2009 would this work out
