  • Lowell and three mobile

    Lowell own my 3 accounts with three now. All are under £250 each. As the CCA is not relevant, what is the best way to attack Lowell on these?

    Are Lowell combining these debts or chasing each one individually?

    Some more details please.

    1. When were these accounts opened? -- details of each one please.

    2. When were the accounts defaulted --- ? "" "" "" "".

    3. When did you last make any payments? "" "" "" ""

    4. Have you acknowledged Liability for the debt?

    5. Is there any dispute about the accounts /debts.

      They are chasing individually.

      1. When were these accounts opened? -- details of each one please. Dec 2010 - May 2009 -

      2. When were the accounts defaulted --- ? "" "" "" "". August 2012 - October 2012 -

      3. When did you last make any payments? "" "" "" "" May 2012 - july 2012 -

      4. Have you acknowledged Liability for the debt? no - no

      5. Is there any dispute about the accounts /debts. no - no

      The last one is SB and Default falls off in the next 3 weeks

        On the debt reaching 6 years and being removed from CRA does not necessarily
        mean the debt is statute barred.

        When was the last payment or acknowledgment of that debt?

        Is Lowell chasing hard/threatening court action?

          The SB is from 2008 so well past it. They are sending the usual letters and I have had the pre legal one.

            Debt is like any other trap, easy enough to get into, but hard enough to get out of.

              OK tell Lowell that one is Statute Barred and to cease all activity on that.

              The others a relatively recent so what would you put forward as a defence

              if a claim is issued?

                I don't think they have any paperwork for them They have never produced any in my experience with them so I'm sure it wont get to court. I'm wondering if its worth a prov-it letter?

                  AS you say in your first post there is no CCA only a service contract Not regulated by CCA 1974 (amended).

                  You can ask for the service contracts to be produced and see what happens.
