    I have been hounded by Capquest for 4 years now. They gave me a month here and there when I was seeking advice from OFT and the Ombudsman. I have fought my case all this timebut I cannot anymore as the offending debt company I was paying have gone bust. Now I havent got a clue how to proceed but am getting harrassed by them two and three calls a day on mobile text and landline. I am a pensioner in poor health. I have been to CAB but they only advise a DRO which will cost me £90 which I havent got. Please would you advise me.

      Hi, Please give us some history of the debt involved.
      1. Who were you paying ( who has gone bust?)

      Who was the original creditor?
      How much do you owe?

      Capquest have no right to harass you in this way.

      Dear Mr Thomas,

      I refer to the alleged debt for £ xxx,xx for which Capquest has pursued me for some years.

      The conduct of Capquest Investments Ltd now amounts to harassment, the number and frequency of calls to my landline, mobile phone an text messages is now at a level that is affecting my health and I insist all such contact must cease immediately.

      AS you may not be aware I advise you at this point that I am a pensioner in poor health and vulnerable.

      I have been advised to remind you of the Appeal Court Judgement in Roberts- v - BOS in which their Lordships clearly defined the number of telephone calls in a situation where a company has been informed that such contacts must cease.

      Capquest is put on notice that any further communication by any electronic means, landline call, mobile phone call or text messages received anytime after receipt of this letter will be treated as harassment and suitable action will ensue including a report to the FCA regarding the conduct of Capquest Investments Ltd and its fitness to hold a consumer credit licence.

      OK fill in the personal and debt details reference numbers etc. use signed for post.

        Is this the only debt you have? A DRO is a form of personal insolvency similar to bankruptcy but cheaper and with more restrictive criteria.

        Could you give us more details about this debt?

          The aspects on Harassment by phone after a creditor has been required to desist
          from such conduct has been greatly modified by the Appeal Court Judgement in Roberts - v - BOS ( 2014).

            which debt company? How much were you paying them?

            Do you have other debts as well? How large are they in total?

            £90 is not a very large amount of money. But if there are particular reasons why you feel unable to save it up over a few months, then you can ask Citizens Advice if they can help you to secure a charitable grant to cover this.
