    Well, Wednesday was the deadline and sure enough received 2 letters. One was was 1st credit saying that they'd advised the court of their intentions to proceed. The 2nd was from the court and included a Notice of Proposed Allocation to the Small Claims Track, with a questionaire I need to fill in and return (to both the court and 1st credit). The claim form looks simple enough to fill in but whats the deal with mediation? Just seems like a waste of time is all I'm thinking but happy to jump through their hoops. How can I find out where my local county court hearing centre is?

    Hi The HMCTS Small Claims Mediations Service is there to assist the parties to a claim reach a resolution to the claim with out recourse to a court hearing. It is expected that both parties will partake of the opportunity to settle, for the defendant the benefit is that if a mutually acceptable agreement is reached no CCJ is recorded as long as the terms of the agreement are maintained. This agreement is set out in consent (Tomlin) order sealed by the court, however if the defendant breaks the agreement the claimant can apply for summary judgement.

    Tick yes to the mediation, if the claimant fails to supply all the documents request in a CCA request and / CPR31.14 request then mediation cannot take place and the claim is returned to the court.
