  • Help in getting money

    I am so depressed as I write this: after several years of being sick I managed to take to court a Belgian surgeon (with office space he rents in the UK to convince patients to travel to Belgium). I firstly used a Mediator with no success though. I went via the Small Claims Court and then via the County Court at central London and I am in the possession of a Judgement order made in my favour. However, even one year later, this surgeon did not pay and ignores me, just the way he ignored letters from General Medical Council UK who now posted a Warning on his GMC page.

    How do I get the money back: using a N293A form or a Statutory Demand order to which he might chose not to respond but will declare him bankrupt in the UK, meaning GMC might remove him completely off their list? Shall I enforce this via a Belgian lawyer, although Belgian courts are apparently the slowest in Europe?

    Shall I write an open later on the internet detailing facts from the GMC report and shame the surgeon?

    Could you not now use court bailiffs to get your money back? You have the judgement in your favour, the man hasn't paid ... if you believe that there's a chance that he will attempt to leave the country rather than pay, a walkng possession order (put in place by certified bailiffs) would certainly be an option
    Debt is like any other trap, easy enough to get into, but hard enough to get out of.

    It doesn't matter where your journey begins, so long as you begin it...

        The Belgian surgeon is based in Belgium (he is a multi millionaire) yet he only rents a room in a Belgian clinic in London when he comes here once per month, for many years.

        Any other ideas?

              Thank you everyone. I will look into this, although I am concerned the Belgian doctor might not respond, just like in the past and treat me as if I am a little pest. I am so depressed of being treated with so much disrespect.

                With the greatest of respect I would consider chalking this up to experience. No doubt this is someone who treats others with contempt and even if you gain Judgment there is no guarantee you will ever get paid - it could be he is a serial debt evader.

                    You are part way there if you already have Judgment against him, Enforcing it is another matter particularly where cross border situations arise. It may benefit you to talk to someone first to get a feel as to what may be possible a good starting point would be http://thesheriffsoffice.com/faqs/ca...ing-a-judgment . Only you can decide what to do but bear in my mind the extra costs you will have to pay out.
