  • MNNA to IDEM/Robinson Way

    Hi

    Not all of my papers are to hand but looking at my Noddle credit file I see I had a MBNA credit card since 17th May 2006. I stopped paying and the date of default is shown as 30th September 2013. I have made no payments nor had contact with them or their various debt collection agents since then.

    I attach the letter from Robinson Way dated 17th April 2015 asking me to address the balance of about £3,000. This figure appears to have not change for a long time so interest appears to have been stopped. I assume the account has been sold by MBNA to IDEM; is that a reasonable assumption?

    Should I ask IDEM, Robinson Way or MBNA for a copy of my original credit agreement, a signed copy of the original Default Notice, and a copy of the Notification of Assignment? Is that the correct way forward?

    What would your advice be?

            Knowing Idem there is a distinct possibility that no Notice of Assignment
            was issued.
            Is the default date correct?
            The account was opened 2006, when did payments actually cease? A default can be up to
            6 months after the last payment and in some MBNA cases it's been a great deal longer.

            What is needed is a prove it letter to RW, combined with A CCA request for the agreement
            and a current statement of the account, and a demand for proof of DN and NOA.

            Try this.

            To Robison Way, use signed for post.


            Date:..........................

            Ref: Use theirs.

            Sir/Madam,

            I refer to a letter dated............................... from Robison Way dated............... in which it is alleged that I am indebted to its client Idem Servicing in the sum of £....................; Please take note I do not acknowledge any liability to your client.

            I require unequivocal proof of any liability and Robinson Way will therefor supply me with the following documented information.

            1. A Notice of Assignment from MBNA to Idem Servicing.

            2. A copy of any valid default notice allegedly issued to me.

            Furthermore I enclose here with a £1.00 statutory payment in regard to a request made under sections 77/78 of the Consumer Credit Act 1974 (as amended) Robinson Way must provide to me a copy of the properly execute agreement relating to the account from which the alleged debt arises.

            Robinson Way has a statutory 12 + 2 Working Days to comply with this request.

            Yours etc.

            Ok The £1 fee use a cheque od Postal order clearly endorsed " For Statutory Fee Only" ( take a photo copy of the Cq or PO showing the amount and the endorsement.

            Send by signed for post check delivery date.

                I have multiple letters from MBNA regarding this but not since it went to IDEM. Robinson Way's letter of 28/03/2015 says 'Your account details have been passed to us by out client to act as collection agent and we will now be dealing with this account on their behalf.'

                My last payment to MBNA according to their statement was 08/01/2013. They wrote a letter dated 18/10/2015 stating that my credit agreement had been terminated.

                A letter dated 30/08/2014 from Wescot working on behalf of IDEM Servicing offered a deal at £2xxxx.00 saying this is a reduction of £xxx.00 or 75% of my current balance.

                No letters have been responded to nor calls answered.

                I have amended your suggested letter slightly as the first line had the date show twice.

                I refer to a letter dated 28th March 2015 from Robinson Way in which it is alleged that I am indebted to its client Idem Servicing in the sum of £xxxx.00. Please take note I do not acknowledge any liability to your client.

                I require unequivocal proof of any liability and Robinson Way will therefor supply me with the following documented information.

                      With a bit of luck, they won't be able to find anything. ray: MBNA were never able to provide me with anything and I've not heard from them since December 2011.

                      Robinson Way are only acting as debt collectors so they may well return the account to Idem if they are the current owners. Strangely my MBNA never got sold to anyone after all these years. :confused2:

                      Do keep us posted if you hear anything from Robinson Way, Idem or anyone else. :typing:

                        As promised, here is an update: I have had a reply from Robinson Way. They say 'We refer to the above account which will no longer be managed by this office,' then refers me back to their client. Photo attached but the quality may not be good. I have had no response from MBNA fo0r 3 months regarding my CCA request. I will let you know what happens next. Thanks

                            Hi I have now received two letter, one from Idem Servicing saying that the alleged debt had been purchased by Arrow Global Limited and one from Arrow confirming that with a Notice of Assignment embodied within it. Do I ask them for the original CCA all over again?

                              I have since received a letter from capquest are now managing the account on behalf of Arrow Global Limited. Should I ask for the CCA etc again?
