    Hi Folks,

    Long time no see on this forum. I am hoping that someone can offer me some advice. On Tuesday 17th March I came home to a nasty letter on the doorstep - clearly delivered by hand. Upon opening it I read "Due to your failure to pay an Outstanding Warrant of Control an agent has today attended your premises to arrange payment." The balance was £385.00

    I had received no prior correspondence from Marston at this stage.

    I have no idea what this is about - I have an inkling that it is in regards to a neglected vehicle fine, but not 100% sure. As I was travelling from Thursday and returning on Sunday evening I made a resolution to send a letter to Marston on Monday to enquire about the charges.

    At 6.45 on Monday morning an "Enforcement Agent" knocked on my door. I opened it to speak with him and we had a long conversation which he recorded with a camera on his vest. I explained that I was unable to pay the full balance of £385, but I could afford to set up a payment schedule to clear the balance. He immediately refused this and asked me when I would be able to pay and I suggested that I would contact him today. He left a mobile number for me to call him on and said that I must call that number and not the office number printed on the letter. He left another letter with his number on.

    I tried calling for him a couple of times this evening, but no answer - I called the office who immediately informed me that the balance was now £620.00 as the "enforcement stage" had been started. I offered to make a partial payment, which they refused and asked me to call the Enforcement Agent directly, so I called him again and the call was connected:

    He answered and informed him that I was going to record the call for my own peace of mind. He consented and I offered to pay £120.00 today towards clearing the balance and then o set up a formal payment schedule. He advised me that now I could only pay via a payment schedule and not in full the office was correct in that the full £235.00 enforcement fee must apply bringing the total to £620.00.

    He also advised me that the balance must be cleared within 12 weeks otherwise he would be attending my home with a locksmith to seize goods. The same threat he had made at his visit.

    I understand that new regulations have come in since I last had to deal with one of these guys, but even so something doesn't seem right to me.

    Can anyone offer me some advice on where I stand with this and also let me know whether there is any way I can save myself the £235.00 considering I was willing to pay right off the bat?

    It also appears, via a quick search on the Certificated Enforcement Agent (Bailiff) Register that the gentleman attending my property is not a registered bailiff/enforcement agent.

    He has applied for a license, however, he has not been granted it yet and the hearing is on the 24th April 2015.

      If he's not licensed/registed yet, then I'd (personally) be thinking about putting in a formal complaint (with screenshots etc... as proof)

        Chances are it will be a renewal.

            The only sure fire way to find out is speak to the person concerned and ask where his current Certificate is at and the dates of it. They usually go right up to the renewal date if that is what this is. If it is a new application then he could well be in deep doo doos and if found out then will find it difficult for the application to go through if a complaaint is made.
