    Please help!

    How do I get this set aside or what do I do next?
    Pi really can't do with marsdons coming round to the house again.

    Represented by Taylor & Emmett LLP
    S1 2PP
    DEFENDANT us Limited company
    Before deputy Judge.....
    It was ordered that

    1.the existing claim form be replaced with the claim form attached
    (which is in fact a photocopy of an n1 form) with details of the claim)please help I don't know how to handle this



    2.because the order made an application of a party without notice of a hearing being given the other parties have a right to have the order set aside


    A party making an application must send or deliver the application to court


    A) the party making the application is the defendant?

    b) the defendant is an individual
    (no limited company)

    Then upon filling of the application the claim will be transferred to the defendants home court.

    In all other cases requiring the claim will be transferred to the preferred court.

    I shall explain as

    I do do not know how to approach this

    a purchase order order was made with lead time 3-4 weeks with 1.Additional week for cuttingof the product.

    the claimant was made most aware of the urgency of the materials arriving in the specified lead time.
    we find out the claimant;
    Didn't order the materials until 15 Days later than requested

    on the fifth week he requested an additional
    £610.00 for express delivery for getting them
    delivered after the 6th week
    he more or less made us agree to this as the client was threatning all sorts

    (Which resulted in us having to give £500.00 discount
    for embarrassing the company) again we had to agree as they were not happy & were withholding payment. That with the threat of LADS as we finished later due to cutting onsite

    hire a van plus fuel pick the panels from a depo in sheffield back to Leeds 2 men 1 day
    8 days additional labour just for cutting on site
    3 men additional labour

    have not received anyofficial court papers
    if anything the company owes us money
    please help

    If you were not warned in advance that a judgement would be issued then you have every right to ask that the order be set aside. There should be instructions contained within the court papers giving details on how to do this. Do you not have them?

        Can you scan in the letter you have pls, along with the copy N1.

        It sounds like they have put in a claim and been ordered to amend it, or applied to amend it. Is this the first you have heard of it ?

        It sounds like you now can defend the claim, but really need to see the papers first to know exactly whats going on here.

                    Hi there,
                    I didn't realise anyone had replied thanks I will read through your messages and will upload the guidance notes photocopies.
                    We received a photo copy of N1 acknowlement to send to the court.
                    Photocopy of the judges order. With the the guidance noted above. Husband won't let me do them now lol I will upload in the morning
