    Hi all
    I'm new and have been dealing with this matter since 2011. Basically, I requested a CCA from MBNA back in March 2011, they simply ignored my request, I got a letter some 13 months later saying my debt was being passed on. The original Application was with Bank of Scotland. Since that time, it's been passed from one DCA to another and I've fought them off every step of the way as no-one could provide me with the CCA.

    Anyway, the matter went to Rockwell another DCA and I fought with them, they provided a copy of the Credit Application form dated 1999. It is just a poor photocopy but out of all the DCA's they were the only one that sent me the CCA. Now they threatened everything so I sent the usual letters and then mentioned the lack of prescribed terms etc. They closed their file and I never heard a word for over two years. I then get this letter from ARC Europe threatening court action etc, I wrote back enclosing all the correspondence with Rockwell etc and they just won't go away. They are saying that the 1999 Application I signed is compliant with the CA and that I need to pay or get taken to court. I really cannot see any prescribed terms and I'm a bit stumped on what I should reply back. Again they have sent very poor copies of what looks like the same document I sent to them but you can barely read it! All they keep saying is when I made my last payment. They've not outlined as to why the CCA is compliant just that they are instructed that it is.

    Can anyone help - they seem very determined but maybe that's their method of working to wear people down to get payment!

    Hi, some details please.
    1. Have you checked your credit reference files for this debt? If not a quick check with " Noddle" it's free online.
    2. When was the last payment or unequivocal written acknowledgment of the debt.

      It was Feb 2011 was when I made my last payment. On 13th March 2011 I requested a CCA - no response whatsoever, got the default notice, still nothing from MBNA despite me writing to them. The debt was passed firstly to AIC - something like that, who never did anything before it went to Frederickson/Bryan Carter...Rockwell then Shakespeares then ARC. All I've ever received is a copy of my application just that nothing else.

        Is there any chance you could remove your personal details and post up the letter they've sent you along with the application form and terms? :typing:

        They are trying to establish the debt is not statute barred by going on about last payment date. As for the CCA being compliant, we'll have to see it to believe it.

        It is indeed! DCAs only make money if they manage to extract money from you!

          I'll have a go - I'm on a mac so I'm guessing I scan it in and remove info in Photoshop or copy one, remove personal data then scan!

              That's right scan, redact and then upload as an attachment

                You can easily remove personal info in Photoshop in a number of ways:
                • Using the eraser tool
                • Using a brush to paint it white
                • Using a rectangular selection, then pressing DEL or filling it with white

                If you have the full Acrobat (you may do if you're using Adobe CS on a Mac), you can scan as PDF and edit the PDFin Acrobat, selecting the text and deleting it.

ID:	1164578 Here are the documents. The Application Form copy is all I've ever received. No other documents were sent to me. In fact, ARC sent me a copy back with no other documents. It's not very clear at all but I couldn't see any prescribed terms in it!

                    Just want this matter resolving now.....

                      Anyone? ARC are leaving messages...Grrrrr! Is this Application based on it's date likely to be enforceable despite what ARC are claiming?

                        Hi,

                        Is the last payment date stated correct, are there any terms and conditions supplied with the app form?

                        I am struggling to find amongst the very small print the words; " this is a credit agreement regulated by the Consumer Credit Act 1974" can you confirm that is there please.

                          I've found the original letter from Rockwell and it states enclosed is a copy of CCA and a Statement no terms and conditions were enclosed. It was just a photocopy of the Application Form. I'm just trying to find the copy they sent to me! I can't for the life of me find it.... yet I had when I wrote to ARC before Christmas!

                            Can you clarify please Does the wording on the APP for include " This is an agreement regulated under CCA1974" any where upon it?

                              I still can't find it! I haven't a clue what I've done with it and now all I have is two illegible photocopies that I can't read. I'm so annoyed with myself!!!!
