    Hi

    Just after some advice if possible,

    I had a TV license fine from an old previous previous address which Marstons were previously sent to collect, this was maybe atleast a year ago.

    At the time with all their fees etc there was no way for me to pay it , the bailiff called a few times at 6:30am in the morning, refused to leave the premises when he was told he wouldn't be coming in and I couldn't pay unless it was installments (we were on a low income and in a housing association property), the bailiff straight out refused installments etc. etc after a few complaints to Marstons offices I was allowed to pay the fine off in installments, so paid it and thought great that was the end of it.

    Today (Saturday 28th) at 12.25pm I had the same bailiff from Marstons knock on the door, I didn't open the door or speak to him, totally ignored he was there as I am at home alone with my 3 year old and didn't feel comfortable opening the door or speaking with him ( he is easily 6ft+ tall and looks like a a biker!)

    After a while he put a letter through the postbox and left.




    Basically says I still owe the court £70, I have just dug out my records and it does seem I calculated wrong somewhere with the installments and missed the last one!

    What can I do to get this sorted? this is the first I have heard that I still owe an installment, My partner and I are currently on Income Based JSA and full HB allowance, there is absolutely no way I can pay this with the added fees, even the £70 straight to the court wouldn't be possible unless it was by low installments.

    Do I have a leg to stand on anywhere? I really don't know what to do and really don't want him coming round again as it was pretty un-nerving for us. Having to pay those silly fees that are more than the actually fine is ridiculous.

    In your post you say that after making a complaint that you were allowed to pay the fine off in instalments. At that time what bailiff fees had been added?

    Also, who were you making payments to....Marston Group or the court?

      Not sure what fees were added and I was paying to Marston via a payment card at the post office.

        You should have received an initial Notice of Enforcement and a Compliance Fee of £75 would have been added. If you did not pay within the time frame given on that notice then a personal visit would have been made and this would incur an 'enforcement fee' of £235.

        Was your complaint made before or after a visit was made? The reason for asking is to determine the fees that had been incurred.

        On 6th April last year the enforcement of magistrate court fines was included in the same enforcement regulations as those of council tax and road traffic areas and shares the same fee scale as above.

        Did you make a payment proposal during the compliance stage and have you provided details of your financial position to Marston Group?

          Bit confused with what you are asking but I will try and answer.

          The complaints were made after visits were made when the initial collection of debt was attempted which was over a year a go.

          I then complained about the conduct of the agent etc and was allowed to make installments which I did, albeit I seemed to miss the last payment
          (which thinking back may have been because my partners job finished and they didn't pay him and then totally messed his pay up when they eventually paid him, This was around January/February time last year)



          So I basically paid the whole of the debt off in 2014 except £70 which Marston are now trying to collect plus the fees on the notice and this is the first I have heard from them regarding the debt since I made the last payment to them. I honestly would have thought they would have sent me something when I missed the last payment in 2014 but I've had nothing and we haven't moved house or anything.

            Still urgently looking for advice

            Earlier today while getting my daughter ready for nursery I had a red final notice letter put through my door saying the baliff would re-attend over the weekend to take control of goods for sale at auction.

            I have contacted the court regarding the £70 that is owed and explained that I had had no notification , until the bailiff, that there was still money outstanding and that we are on JSA, HB an in social housing with a young child and that my partner also suffers from anxiety (diagnosed) I asked to deal with the courts directly and asked for them to recall the debt back so I could pay it off directly.

            They replied saying they and Marston had sent me numerous letters and that I had to deal with Marston. I honestly didn't receive anything from either of them, if I had've received a letter from the court I would've sorted it asap.

            I am totally stuck and panicking as I don't know what to do and worrying about the bailiff visit over the weekend.What exactly can they do?

            Any help or advice would be very much appreciated

                    I understand there was £70 outstanding when the last arrangement was breached, have they added any further fees since, or is this still the total amount due ?

                      Hi Andy, thanks for replying,

                      The £70 is the total amount due to the court for the fine, Marston have now added £310 of fees to that.

                      (the total amount 'due' on today's letter is £380)

                        HI, Just trying to work out why you have seemingly been charged two compliance fee charges for the same debt.
                        I think the earlier payment was due to Marstons, so the unpaid amount has been passed back to the court and a new warrant issued it seems. This means that you would have paid two lots of compliance/first stage fees.
                        If this is the case you should have had a letter before the enforcment stage fee was added(235) to give you chance to pay.

                            I can't find any paper work from the original fine, I vaguely remember the fine being £120 or around that as for bailiff charges I honestly have no idea sorry.
