Don't worry about the exhibits, the judge will have a copy xxx You will be absolutely fine Try and treat it as an adventure, and let us know how you get on. The Judge won't be asking you anything complicated should simply be about what happened, which you know, so as long as you get the point across your were mislead and didn't ever intend to use a third party to book an appointment you will be absolutely fine. Good luck - will be keeping my fingers crossed for you xxxx

            **********WON**********arty:

Tricky Dicky did not turn up as we all expect by now, he had sent a last minute letter in only logged this morning saying his reasons but the judge didn't say what he had put but I could tell she was not impressed at all.

She opened by saying she had read my 54 paragraph witness statement and had not needed to refer to the exhibits as my statement was that clear and in depth that it was clear I had not willingly entered into the alledged contract and done everything possible to cancel it. He had ignored all my attempts to sort it out with him even my offers of payment and could empathise that this must have been very stressful for me. She said she doesn't believe the contract is legal and that nobody in their right mind would sign such a thing if they were in a building with all those contract details infront of them on actual paper. In her eyes the only way she believes a contract is legal is when you have paperwork infront of you in a building and you read it all then sign it. She then asked me outright what I would like to happen which I thought was a little bit strange so I said " I am here to defend myself in the fact that I 100% believed I was on a government website and had no intention of entering into any contract with anybody" so she said I am going to dismiss it because I believe you had no intention of using his service and tried everything to cancel and he chose to ignore it. You then tried to resolve it and he chose to ignore your attempts at doing this to, he is not here to answer any of my questions so the claim is dismissed. She them said I notice you have asked for costs which is unusual but given the amount of time you have spent preparing this case I am awarding £120, I don't think you'll get it from him but good luck. She then wrote the order out verbalising it as she wrote.

When all that was done with she looked up at us and said " Do you know I was only listening to radio 4 You and Yours last week I think it was and they were talking about this man and I can tell you he is an absolute rogue and deserves everything he has got coming to him but that is off the record between you and me!" She then smiled and wished me good luck. We then got up with all my notes and left and that was it.

Just relieved it's over and part of me wishes he had turned up as she would have ripped him apart I think now knowing she knew of him from the radio programme so well done You and Yours keep up the publicity on him it's working.

I am going to email Russel from Trading Standards and let him know I won my case as he wanted to now. I really hope they are working hard to prosecute him still.

Amethyst and all of LB thankyou thankyou thankyou your support has saved me from having a nervous breakdown over this I am sure of it. You are all angels xxxx

Good luck to the next guys going through this this week and all month and Sept.

Yes despite having a panic attack last night when I couldn't find any exhibits I am glad I pushed through my nervous disposition. I was determine not to let this horrid excuse of a human to bully me. Do I chase the order for costs directly with Howard do you mean. He should be made to pay up to everyone of us and I really hope Ethan gets his big costs.

When you get the order from the court, you can email Richard Howard and give him seven days, then instruct bailiffs if you wanted xxx He has actually been paying though. Completely agree, he should be made to pay far more to compensate for the stress this puts people through.

So later on this afternoon I informed Trading Standards man that I won my case. He rang me shortly after to congratulate me and gave me some update on where they are with Howard. My guy who came to my house was there with the team who went to arrest him in Wimbledon along with his employees. He said they are working on their case with a Barrister and they hope to be dealing with him in October. He said part of his bail conditions is he isn't allowed to contact any of us he has issued court proceedings to and is not allowec to chase anybody for non payment. So i assume Howards only clientele are people who fall hook line and sinker on his website and pay imediately. He asked what my judge thought about the contract to which I said she thinks it is illegal. He replied that is what our barrister is saying to.

So fingers crossed even though we think it's gone quiet they are still very active pursuing him.

Amethyst shall I get in touch with Russel the TS guy who came to my house and ask him what RH is playing at referring people who have won and owed costs to Mike Andrews and ask will Mike be doing anything about the emails we have sent him as he is not repIying either. I feel RH is giving us all the final run around.

I know Andy is on holiday, so I can't badger him about it, so yes speak to Russell. I'll see if I can get hold of Mike - he may be on his holibobs too. Let me know what Russell thinks.

Otherwise it is going to be a case of getting a warrant of control and shelling out for bailiffs.
