very catalougue / shop direct finance debt

  • very catalougue / shop direct finance debt



    Hi
    looking for a bit of advice ive got myself into a big debt with very catalouge & can no longer afford the £400 month i was paying
    I cant bring myself to phone them as ive been receing letters & phone calls daily
    I ceased payment in nivember 2014
    I know i have ti start paying & can afford about £30 a minth which i know they are going to refuse
    ive sent a CCA Request & today i received a very swift reply
    my account was opened on 27th april 2009
    they have sent me the following
    1.a re-consituted copy of my credit agreement sent to me at the time of opening account ive not signed anything
    2 . A copy of my current credit agreement which includes all applicable contractual variations and ammendments that have taken place since opened
    when i did a cca previously on another company i had pages & pages of statements
    None of the paperwork received has my signature on only my name and adress typed it also hasnt got a signature for a representative of the company
    Is this a true copy of my credit agrrement ??

    £400 a month for a catalogue account? That sounds outrageous! :scared: How much is the outstanding balance? :noidea:

    You're right not to ring them, keep it all in writing and keep a log of all their phone calls even if you don't answer them. :typing: If they are as frequent as that, you may have an argument for harassment. See this: http://www.legalbeagles.info/forums/...ing#post484844

    You can't pay more than what you can afford, remember your priority outgoings and debts have to come first, these are your mortgage or rent, any repayments on loans secured on property, council tax, utility bills and, if applicable, tax debts, maintenance payments and court fines. Then you have to allow for food and daily expenses for your family, Very come at the very (sorry!) bottom of the pile! :grin:

    A CCA request should include a statement of account but not necessarily the full account history, you'd normally send a SAR to get all your statements. S.78 of the CCA deals with CCA requests.
    After the Carey judgment, it was established that a reconstituted agreement is an acceptable response to a CCA request, however, the recon has to be honest and accurate.
    As you opened the account after April 2007, if this went to court, the court would not be prevented from enforcing this debt even without a properly executed agreement, as s.127 of the CCA which prevented a court from doing so was repealed with effect from April 2007.

      Hi Lisa

      I would contact Stepchange http://www.stepchange.org/, and talk it through with them, and any other debts/circumstances you have. Then telephone Very. There is no need to be scared they are actually very nice. I'll get a couple links for you in a sec.

      Very can put you account on hold for seven days to give you chance to speak with StepChange. Once you have been through things with Stepchange you will be able to give very a reference number and they can put things on hold for 28 days. This will give you chance to get a DMP set up, which if you can afford £30 a month will be for that, or maybe less if you have over estimated.

      Your account wasn't opened until 2009, the agreement is going to be affordable and playing games with them will just serve to rack the debt up with the insane interest and late payment charges.

      That's the plan of action I have just taken when things started going a little bit bananas as my interest free period ran out.
