    Hello.
    I am really worried about a attachment of earnings letter I recieved 2 days ago for a debt that I forgot about and is almost 6 years old. The original debt I had was with halifax Plc which has now been taken on by capquest and their solicitors drydens fair fax. I do acknowledge the original debt but I had no idea that cap quest had bought the debt and have added extra charges to it. What are my options, it say I have 8 days to respond .any advice would be greatly received . Thanks

    hi there we have had the same thing ..but the paperwork looked dodgy to me..above the name crossed out in marker pen ,not sure a legal letter would do this ..also on the reverse ,where it says a box should be ticked and signed by a baillif to serve the papers everything is blank ...so was it legally served ???? help please threatens prison if not replied...

      The threat of prison is in relation to " contempt of court" i.e. ignoring/failing to comply with an order of the court.
      If a bailiff did not serve the document it can be posted.

        i see that may be the case ..but shouldn't they have ticked the box that they were sending it and then signed it on behalf of the baillif? everything is blank and then they say send all paperwork to a different court in essex..been reading up on this firm all sites say they are using illegal tactics.. regards

          The same here , the back is not filled in at all can they legally force a document that has not been legally filled out?

            The matter will have been transferred to the court nearest to where you live.
            Don't ignore this, the judgement is in place and the claimant in going to enforce
            it by way of an AOE.

              I'm just going to hope that they will accept my offer of affordable monthly payments. Do I have any right to ask capquest for original documents regarding my debt ?

                They have a CCJ you will not get any original documents now expect they may still go for charging order to guarantee they get the money either by payments or if and when the house is sold if there is any equity
