You phoned on 13 May 2014 to arrange further time to pay. At this time you agreed to pay £30 per month from 1 June 2014 and you told us that you were going to Ireland, but the adress of 10 Lottie Rd was fine to still use.

You paid as ordered in June and July. You called on 13 August 2014 for your account number to pay online. You did not mention a new address at this point. We received your 1 August 2014 payment of £30 on 15 August 2014. You failed to pay in September, so we sent you a Further Steps Notice to 10 Lottie Rd dated 1 October 2014.
At no point had you contcted the court to tell us you no longer live there.

You paid a further £10 on 6 October 2014. We correctly sent your account to bailiffs on 15 October 2014. Although you say you thought you had paid the fine, you paid a further £5 and £20 on 4 November 2014 and 10 February 2015, both via the internet. We have sent both of these payments to Collectica towards the amount you owe them. You must now continue to pay Collectica for this fine.

No luck. Looks like I'm going to have to find some way of paying.

A very quick reply but very detailed as well and sadly I cannot see from the above that there is any prospect of the account being recalled by the court or returned by Collectica. I would suggest contacting Collectica with a detailed Income & Expenditure and to request that the agreed repayments be reduced.

Sorry, but the debt that has ballooned from £17 to £327 and the advice is to pay it? No way. That is blatant profiteering and an abuse of the system. Complaints need to be made at the highest level. You have already paid £49, and I say pay no more and get those complaints in now.

Just as it isn't clear, is this the court response to the letter you sent them as Milo suggested yesterday morning ??

        Dear Sirs,

        Re: Account reference:

I am writing with regards to the above account which relates to a court fine of £126 imposed against me last year for travelling on a train without a valid ticket. From your records you will see that I made payments against this fine and it was my honest belief that I had settled the debt in full.

On 4th February 2015 I received correspondence from a company by the name of Collectica Ltd seeking payment of £327 which comprises of a balance against the court fine of £17, a Compliance fee of £75 and an Enforcement fee of £235. I immediately contacted your court and was surprised to discover that a balance of £17 was still outstanding against the court fine and I was advised that correspondence on this matter had been sent to a previous address where I had been living until April 2014. I had not received any letters given that I went to live in Ireland for 6 months (I returned to the UK in September 2014).

I understand that HMCTS need to to be seen as pro active in collecting criminal court fines but I feel that issuing a warrant for £17 in the knowledge that a Compliance fee of £75 alone would be more than 4 times this nominal amount is not only heavy handed but is wholly disproportional to the amount of the court fine. The amount being demanded by Collectica is now 19 times the original debt and given that I am a student it is impossible for me to clear this amount.

From advice that I have received I understand that the correspondence that had been sent to my previous address would have been a Further Steps Notice warning me that the Fines Officer would be seeking a warrant for the arrears of £17. If I had been living at the address at the time that this letter was sent I can assure you that I would have paid this sum immediately. However, as mentioned above, I moved from the address in April 2014. I did not write to the court to update my address details as I honestly believed that I had paid the court fine in full.

I would be grateful if you would consider recalling the warrant of control from Collectica Ltd for the reasons outlined above.

        Yours sincerely

        Mr xxxx

I think that you will find that this is the court's response (sent very quickly) and sadly appears to be very detailed indeed and whilst I still stand by my earlier opinion that a fine of £17 is wholly disproportionate, I frankly consider (from the court's reply) that a complaint along these lines will very likely fail. That is not to say that a complaint should not be made.....but I would not hold out a lot of hope of success.

PS: Given that this debt is a court fine there is as I have mentioned in an earlier post, the right to force entry. Accordingly, any advise to 'sit it out' is frankly dangerous and foolhardy.

            Re: Collectica partial fine .

            It was very speedy.

Is the courts response accurate ?

            ie.

You told us that you were going to Ireland, but the adress of 10 Lottie Rd was fine to still use. is that correct ?

            You paid
            June £30
            July £30
            August £30
            September £0
            October £10
            November £5
            December £0
            January £0
            February £10

            is that correct ?

You could continue arguing the point but as this is a court debt and they seem to be correct (procedurally) in passing it on to the bailiff ( paid August a bit late, nothing in September then £10 in October ( which does sound like it was paid because you'd received a further steps notice tbh) so I'd get the payments sorted first.

              so ...
              £30 - June 2014
              £30 - July 2014
              £30 - August 2014
              £10 - October 2014

              £5 - November 2014
              £20 - February 2015

if the enforcement fees had not been added, there'd only be £1 due

Kati. Well spotted and you could be correct given that the court are stating that a Further Steps Notice was issued on 1st October 2014 and a payment of £10 was received on the 6th October (which was within the 10 day period given on the FSN).

It really is important for the OP to contact the court to find out the amount of the Further Steps Notice and the clarify the precise amount of the warrant. I would hope that they respond as quickly as they did yesterday.

At the time I was only going back to Ireland for a couple of days. I returned shortly after, my address was still valid then.

I think payments are correct except for February. That payment was for £20. Unfortunately I paid for some via web and some via phone because I could not log onto the website from Ireland. It's proving difficult to track now.

I received a text message in November for the first time stating that I need to pay. No amount was given.I thought I had it cleared already, but I could have owed a few pennies. I decided to do another payment of £5 to be certain.

The Enforcement Fee is what angers me the most.

I will contact the magistrates court Now. The amount on the collectica warrant was £322 when I received it. It was initially £327 before my November Payment was passed to them.

                    Re: Collectica partial fine .

Again ... (not counting a cost for the final steps letter - if any)

£26 - due when sent to bailiffs
                    +
                    £75 - compliance fee
                    -
£25 - payments after bailiffs involved
                    =
                    £76 owed
                    .................................................. ............
                    £76
                    +
235 - enforcement fee (only added at this stage)
                    =
                    £311!!

as we've already seen, the £17 'owed' is wrong (should have been £26 if the court letter gives the correct amount) - so, the amount now due should be less too!! It should be £311 not £327 (a difference of £16)

                      Re: Collectica partial fine .

The original fine was £117 as stated in their reply. Paid as follows:

                      June £30 - balance now £87

                      July £30 - balance now £57

                      August £30 - balance now £27

                      October £10 - balance now £17

So the balance at the time of sending it to the EA was £17

                      Other payments:

                      November £5

                      February £20

                      February £49

Total paid to date = £174

                      I wouldn't pay them a penny more.

The bailiffs came around last friday requesting i pay the remainder of the bill. Luckily my Parents were able to give me a helping hand and pay the rest off.
