  • rossendales 'notice of committal action'

    Hi,
    I have a council tax debt which has been taken over by rossendales, when they furst got in touch, my partner and i set up payment plans. The original debt was £435 with all the bailiff costs on. However for some reason (which i cant remember now) we stopped paying it. By the time they have got round to getting back in touch, what we had paid off the debt has now gone back to £435 because they have slapped their charges back on.
    My partner and i split up in july last year so i am on my own in the property with 2 children, i went to see citizen advice with the letters i had and was advised to pay small installments while my benefits and wages were being sorted. I had a letter off them telling me to pay £40 a month, at the time though i was trying to make ends meet and find enough money to pay my rent.
    I then recieved a letter on friday telling me that if i dont reapond ro this letter within 7 days, they will be making an application to the magistratea court for a hearing to consider committal to prison. I could be committed to prison for a period of 90days.
    I am worried sick, i have emailed them and said i am willing to pay the debt but i cant pay the full amount up front. Their reply was they can not discuss in an email.
    Where do i go from here?

    Rossendales cannot apply to have you committed to prison - that would be for the council to do (and only if you were in the "won't pay" not "can't pay" category). I've got a feeling that they are trying to scare you into agreeing to pay more than you can afford at a time.

    Did you pay the original debt (plus their charges) or just the CT part of the debt?

    You need to find out from the council
    1. How many Liability Orders they have against you?
    2. The dates they were obtained?
    3. The addresses they were for?
    4. The period of time each covers?
    5. How much each one was for?
    6. How much is still outstanding?
    7. The dates they were passed on for enforcement?

    You also need to write (email's fine) to the bailiffs and ask how much of the total amount of the 'debt' is their charges, requesting a breakdown of them.

    As I previously said ... Rossendales CANNOT apply to have you sent to prison

    I don't see why they can't - it's best to keep EVERYTHING in writing with bailiffs. Maybe you should inform them that ALL dealings must be in writing. That you will not allow entry to your property for any of their agents, and that you will not answer the phone. :tinysmile_twink_t2:

      Write a letter headed "Formal Complaint", addressed to the CEO of the council. Send a copy to Rossendales.

      State that you are a single mother of two and in reciept of benefits. Advise that Rossendales are making unrsasonable payment demands on you, which are at loggerheads with Government guidance. In addition, they are threatening you with prison. You would remind the council that as a single mother, prison is not an option, as you have a right to family life as prescribed in the European Convention of Human Rights. Prison is not an option available to the council. These threats have caused you great distress.

      As a resolution to your complaint, you require Rossendales to desist in their threats and also permit you to enter into a plan that reflects you status or benefits.

        Also ask for enforcement to be suspended whilst the complaint is investigated.

          As you are a single parent, apply for any single person discount for council tax, as some of the debt might be wiped by that, be cheeky and ask for a backdate to when your partner left.

          The Formal Complaint needs to go in pronto, also copy to your local council member who may be able to help you, contact them ASAP anyway to help you, they need to know what devious and potentially unlawful methods their appointed agents are engaging in as Tossendales need a tolchock for threats of prison. Perhaps a copy of the letter needs to go to MOJ .
