    Dear All,

    My name is Anna, I am glad I have found this forum. Everyone seem to be so nice. I hope you are all well!
    If I found you earlier, for sure I'd be much better by now. Please excuse my English at times, it is not my mother tongue.

    Not sure how much details should I give as the situation reaches 28th August 2014. I think best is just to say what I need much appreciated advice for. There is a man who I had sex with, who became dangerously obsessed by me. Although I tried all possible solutions to stop him from seeing me, I was forced to ask the police for help. He kept showing up when I was walking to work, at my lunch time and after work EVERY day. He was arrested and charged with assault and harassment. ( at that time had also had one case against him for property damage).

    I didn't come up as a harassed person in court and lost the case. (the prosecutor started acknowledging herself with the case 4 hours before the trial). They didn't ask much relevant questions. And I replied to my best knowledge to reflect facts and not to state untrue facts. Nobody asked me how the man made me feel and how this all affected me. (By nature I am a very relaxed person who regardless of breaking inside wouldn't show anything out). The trial took place early December 14.

    I started receiving e-mails from 24th of December where the man informed me he is suing me for £100.000 for perjury, and slander, as well as stating police wrote all my statements and made me sign them because they want to get him through me. It broke me with double force.
    I wasn't thinking about the lost case, because at least I had it past me! How wrong my belief was. He e-mailed me 5 times between 24th December and 3rd January 2015.

    I have ignored all the e-mails but at some point I couldn't take it and contacted the detective who lead my case earlier. He told me not to respond and ignore all.

    Then the man showed up at my home address twice, then when I was walking from work one day , he approached me to "serve" court documents. He violently pulled out my earphones, pushed me several times and put his bike in front of me in the narrow passage. Out of 120 page bundle as he said, he only had about 6 loose pages in his hands. I was forced to call the police as I was proper scared he might do something stupid. The police advised me to accept the documents. But it turned out he only has a part of his own copy on him and that he would drop them at my address later on. I didn't tell the police about the pushing, only that I couldn't pass.

    Then he e-mailed me over weekend that he made a statement against me (perjury, slander) which he pasted into the e-mail and second e-mail where he advises me to resign from my work as he will force my boss to sack me for the above offences. Then he showed up the same day to bring me "Judicial Review Form" which was blank. Although I was advised to call 999 right away I have decided to prove to the police how bad this is. Made a 35min recording which I passed on the police. Had threats, insults, and .. some out of context stories that he heard and found amusing (where he was talking to me as to a friend???) The man was arrested but bailed 1 day later. The police became really worried about my safety and unhappy with court decision. The man is to plead end of January this year.

    I am going to get some advice this Monday, to get non-molestation order. (Advised by Police) The man has 2 non-molestation orders against him already, from two other women.

    From what I've been told he has no right to approach me for 12 months after the trial date (same goes for me).


    Questions:
    1. Can the recording be used against him?
    2. Can he sue me like this? I did not lie or sign false statements.
    3. Should I be worried with his claims?
    4. Shouldn't I be served a bundle? I only received 4 pages long blank judicial review form with no references etc.


    I've read a bit and found out Judicial Review is to use against organisations? Maybe I am wrong. But then the police said he is actually trying to sue them more than me and that he tries to use me against them. That I called 999 at the beginning of this all, to get help in stopping him from seeing me but that the police told me he threatened me to kill me etc. Which he did say, and other things.

    I want this over so I can start recovering mentally and put my life back together. Are the any ways to speed it up and defend myself?
    I am sorry for making it so long. Probably I gave too many irrelevant information and missed important things. Hope someone can advise me.

    Hi Anna, welcome to LB

    From what you have said, it sounds like this man is definitely harassing you A non-molestation order (or alternatively an injunction) sounds like the best thing you can do! Have you saved all the emails? they can be used as 'proof' along with any recordings or witness statements.

    Women's Aid (http://www.womensaid.org.uk/domestic...08000100330002) has lots of useful information on NMO's which you might like to read through, while Citizens Advice (http://www.adviceguide.org.uk/wales/...harassment.htm) has info on injunctions for harassment.

    I'm sure you will get lots of advice and support, not just from the police (and other organisations which are involved) but also from myself and the other Beagles too :tinysmile_grin_t:

      I have forwarded all the e-mails and the recording to the detective I mentioned. Right now there's 7 detectives involved! Before they arrested him for the second time I have given a statement (at 3am! officers are really working really hard on this, feels bad) They also insist on me taking some SOS phone to use in case the man approaches me again. Although he has bail conditions not to approach me. But was REALLY mad, shouting and being really angry when the recording I made was presented to him.

      On Monday I have a meeting with solicitors re NMO and right after, victim support. And although the woman said she's here to help me and offered counselling I said I just need one meeting to hear opinion of someone objective and not related to the case so I can move on.

      Also had a call from another organisation but didn't catch the name. They offer support, legal advice and something else as a linked service and was sent by the detective who leads the case. I'll see her on Friday.

      I am just worried I won't show as harassed on the trial (if it comes to this, but probably will) same as on the first trial.. Even my sister, said I was more calm than usual when the man showed up last weekend (when I made the recording). She was sitting behind the door in case something happens.

      I am also worried of the claim he made against me. Although I am confident I didn't lie and that his accusations are baseless but I had enough.
      I don't want to be dragged through courts. Plus he seems really experienced in legal proceedings.

      Nothing was actually served on me but the lead detective said the man DOES have a case in progress.

        Personally (and I know it's hard) I think you should try not to worry. This man (although I am unsure he even deserves to be called that) is a coward and a bully by the sounds of it, and if I was in your shoes I would be doing everything in my power to show him he's picked the wrong person this time

        He can't take you to court until the papers are properly served (as I understand it) which is not the case to date ... He has already broken his bail conditions by contacting you and THAT could essentially mean he ends up in prison.

        You are doing the right thing by passing on all the evidence to the police, and the meetings you have arranged will mean you are more aware of the processes taking place.

          I think I already learned a lot, and will end up stronger eventually.

          He hasn't broken his bail conditions yet. It's the second time he has them (before the first trial he couldn't contact/approach me either) Now since he started harassing me only 16 days after the first trial, threatened and pushed; he got arrested and charged again but bailed 1 day later.
          I think he needs to stick to certain dates and procedures in order to push his case further. He can't serve me personally due to his bail conditions and it being less than 12 months from the first trial date. But don't know what I am going to do when someone actually does serve me. This is nonsense but I am doing my best to endure this all and put past me.
