    If that letter does not allow 7 clear days before the visit, the £235 enforcement fee will be invalid.

    What you can do (in order to buy yourself a bit of time), is write a formal complaint to the CEO of your council. State that you have not been given 7 clear days prior to a bailiff visiting. Advise that you wish to set up a payment plan but enforcement action should not be continuing. Also request that the enforcement fee is removed from your account.

    It is possible that the notice did allow 7 clear days but this would mean it had to have been posted 2 Mondays ago.

    Email Rossendales to advise that they have not given you 7 clear days and that a complaint has gone into your local council. Do not let on that you don't have the original Notice as there is nothing to stop them writing out a new one with a different date on it.

              Whatever you do DO NOT let dossers in. Film him through the letterbox even with a phone to capture any outlandish threats that imply abuse of powers. He has no right of entry. If you have let him in it is then "Peaceful Entry" and keeping him from taking anything is more difficult

              He wants to come in to list your goods on a Controlled Goods Agreement, that will allow him to add a sales fee of £110, plus removal and storage costs if he takes anything away after a default further down the line.

              A little note about payments and dates:

              If the payment date is 31st then the payment must be made by the 27th so the funds are clear into the account by 31st, until they are showing as clear funds they are not paid in Dossers opinion, so if they are paid in on 31st they will not show until 2nd or third of the next month, therefore they will cry default.

                OK, let's calm it down a bit. A bailiff cannot force entry for council tax, he cannot climb through an open window or over a fence. He canot reach through a window or over a fence to open a door from the inside; he can only enter peacefully through an unlocked door.

                Anything of value freely available outside is vulnerable so needs to be moved.

                Some people are easily intimidated by these people, but never forget they are all threats and bluster - they will imply locksmiths and the police will force entry; these are lies.

                If he fails to gain entry, he will eventually tire and return the case back to the council. Any fees will be removed and you can then negotiate with the council to arrange an affordable payment arrangement. If you manage to find employment, you could arrange with the council and Attachment of Earnings order. This is a good solution for those on a low wage as fees are removed and the payments are affordable.

                Just always remember - don't panic, calm your nerves and remind yourself they cannot force you to do anything.

                  He also cannot take a 'levy' on goods inside by looking through a window :tinysmile_twink_t2: If he turns up today you do not even have to acknowledge his knock if you don't want to!

                    Ok so I've rang him directly now I know that might be the wron thing to do but I want to know what he intends to do today. He's til me he just wants to come to sort a payment plan it will take 10/15 minutes and he doesn't want any upfront fees. He seems really nice but in the back I my mind im thinking this is a tactic to make me trust him so he can come in etc. I don't want people finding out I have no one who could come round to be with me when he comes an if my other halfs family appear it'll be world war 3 and I'll never live it down. Sorry for the drama :/ I just feel a bit lost with all this and the fact both the bailiffs office and the council are telling me to deal with him directly

                        I would prepare a statement of income and outgoingsmake sure your priority debts, rent, rates etc are clearly identified and ensure you inlude plenty for food, It would help if you had the first payment to hand.He will want to come in to secure goods,I would not of let him. He will probably say he cannot accept a payment arrangement unless he does, this is untrue. Be prepared to let him walkl away with nothing sorted once he sees you are not going to let him in his attitude will change, as others have said he cannot force entry

                          As Kati says as we all do don't let them in talk through a window or letter box offer what you can afford to pay get a witness with you if you can and record the conversation this nice man will soon turn nasty if he does not get a large lump of your money

                              make sure you ignore them unless you feel you can make an offer come back here the bailiff expert Beagles will come on board and offer help this can be sorted you will have to pay the debt but in a way you can afford

                                I'm willing to pay. More than willing to. I wanted to pay the 152 on the 31st dec. things went daft and now they won't accept my payment. He said yesterday when he handed me te letter that 152 seems a lot to him and he's thinkin more 50-60 a month. I'm so confused I know his game plan is to gain entry but he seems so nice when he spoke to me. I just don't want to get caught in a trap. Are those costs right do you know? The debt was 911.50 and the letter says 911.50+costs which aren't stated but the girl on the phone said 235. Also it says they want an initial payment of 350 an then instalments, he's saying no initial payment is needed "don't u worry love I don't want any money today I just want to help u and come to a payment plan that's affordable to u, I don't want to take any of your things don't u worry" in a grandad voice, is the only way I can describe how he spoke to me
