  • DCA Default Notice

Ive been reviewing my credit report recently and I have two default notices against my name by two difference debt collection agencies. I sent them both SAR requests and got very limited information back. They both really came back to me and send if you want all your information (including anything related to the default) contact the original lenders directly.

My issue is that the defaults are lodged from the DCA and not the original lenders so surely they should be supplying me with the default notice etc or would it be the orignal lender? I dont ever recall receiving anything - both accounts are paid.

    Re: DCA Default Notice

The defaults would normally have been registered on your credit reports by the original creditor, and then the record transferred into the debt purchaser's name when the account was sold, so it then shows under their name on your report.

What sort of warning or notice should have been sent is also highly dependant on the type of account/debt, the circumstances of the default. We would need to know much more detail.

While it is sometimes possible to argue against a default CRA registration on some technicalities, in most cases if you did default and the record shows an accurate history of the account then you may struggle on that score.

I have two (well three technically) - one for Baclaycard and the DCA is MK Rapid Recoveries - I have two defaults recorded for the same debt which I think is unfair?

Another is recorded by Gothia - for a payday loan I had years ago with Wonga.

All accounts are paid off and have £0 balance. I cant ever recall receiving default notices. I was behind with payments at a time and I had arrangements to pay set up.

DN's are not issued on PDLs short fixed term loans.
The Credit files show an accurate picture of the account, account defaulted by the original creditor then sold to a debt purchaser which updates the CRA files, you still only have ONE default with ONE default date. This is acceptable reporting.

I presume the CRA entries show " Date Defaulted".

All defaulted accounts are removed from CRA files on the 6th anniversary of the default date paid or not.
As Nibbler has said I to think you will have trouble challenging this.
