  • CCj questions

    I have two questions that I hope peeps can answe

    1.., does anybody know after 6yrs of a ccj being on credit file (I understand it drops off although it still outstanding debt ). Do they creditors reapply to have it put back on the credit file which I understand they can?


    2. Recd court papers CCJ I have sent my defence. Cabot/Mortimer..
    northampton advised defence sent to mortimer if no response within 28days it will be "stayed". Does that mean it's thrown out of court and they cannot take me to court again?

    1. No it can't be put back on your credit file. Once it's gone it's gone. They can apply to enforce it but will have to have a good reason why they haven't enforced to date.

    2. Claim stayed means it is put on hold, the claimant can pick it up at anytime after that by applying to court. If it gets stayed it's recommended you apply to strike it out.

      Hi thanks for my reply....
      your a star ...you always have helped...
      i read that creditors can have a ccj put back on credit file due to debt be outstanding....it's such a big debt and I will never be in a financial position to pay it off....so will deal with it when or if they push for it,,,

      mortimer...Cabot....I'm not sure if I can get it striked out...I don't think I have grounds
      i have no ccA They Oc have admitted they don't have one its a 1994 credit card I make a regular payment to original creditor and I have never paid any debt collectors for. My debts....never had a Notice of assignments my debt have been bought by debt agencies.....

        Ps....enforce it....I pay by standing order £1 a month ...since the date of 2o10 and will have to pay this £1 until I die or somebody tells me different

            If it was over 6 years ago it will have fallen off your file, the creditors would need to apply to court to enforce from after 6 years.

              Northampton tell me they have 28days...so I won't know til FEBRUARY or before if I get one of those letters telling me I'm a naughty girl or something on those lines
