  • Kktiv Kapital(UK) Ltd changes it's name!

    Just had a letter from Aktiv Kapital (UK) Ltd telling me that as of 6th November 2014 it's changing it's name to Pra Group (UK) Ltd, why would they want to change their name??
    Have they been taken over or (as I suspect) they changed it because of all the complaints to trading standards.
    What-ever the reason they're still pressing for £737.81 for a debt that is 9 years old and 3 years over the statute barred date, they're only letters I know but don't they see that it's never going to be settled.

      You know its only statute barred if no-one has persued you for six years not just if the debt has been outstanding for six years? And why wouldnt you want to settle your debt?
      None of the beliefs held by "Freemen on the land" have ever been supported by any judgments or verdicts in any criminal or civil court cases

        It's SBd when you have not paid anything towards or acknowledged the debt for 6 years no matter if you've had letters about it or not (unless they apply for a CCJ before the 6yrs is over there is nothing they can do)
        Debt is like any other trap, easy enough to get into, but hard enough to get out of.

        It doesn't matter where your journey begins, so long as you begin it...

          Not quite correct.
          Normal Debt Collection, demand for payments etc., from DCAs and debt purchasers are Not Relevant contact in regard to the Limitations Act 1980 only the issue of court proceedings affects this and stops the 6 year clock.

          Swifty The Creditor/DCA/Debt Purchaser can continue to press for payment (of a statute barred debt) until the debtor has informed the creditor in writing that the debt is statute barred, should the creditor continue to press for payment having thus been informed such collection activity may amount to harassment.

          Send letter to AK simply stating the debt is statute barred and you will not make any payment.
          Require AK to remove all data relating to yourself from its records and confirm in writing that it has done so.

          Address letter to the Compliance Manager, use signed for post.

                      This was something told to me many years ago by the guy who ran my DMP and I now of course am pretty clued up on SB , we have had long long discussions on it haven't we Nemesis ?
                      As for why wouldn't you want to settle your debt, why would you if they have not got their ducks in a row . If a bank can not follow the law and get an agreement correct why should they have the right to harass and bully you? Most people do not just wake up one day and decide not to repay their debts , it is usually because of some devastating change in circumstances . The creditors are quite happy to push people to the brink of suicide (and beyond)

                              I sent them a letter (recorded delivery) around 2 years ago, they chose to ignore it and carry on sending me letters demanding settlement in full.
                              I bet I'm not the only one who's done this and still getting letters
