  • DWP letter chasing money back from overpaid benefits for deceased person

    Hi I have been passed 4 letters from the DWP regarding overpayments totalling £300 after my mother died in May, the letters are dated October and I have just received them as I moved.
    I was not aware of an overpayment at the time, and any money in my mothers account was used towards her funeral. I am also unsure why the letter has come to me as I am one of 11 children. Before I contact DWP I would like to know if I am liable to pay this?

    They can only claim against the estate of your mother, no one else. If there is nothing left after the funeral expenses then tough. The letter may have come to you if you acrted as executor of the estate
