        Hi, Just an update, I was too late with the SAR request, before I could send it I had the Court Claim form arrive on my doorstep. I did the usual, sent off the acknowledgement of claim and a CCA and CPR request special delivery to MKDP?. As MKDP have said the amount is £10,777.31, they have added court fess and sooooo much interest its absurd? Should I have sent he CCA and CPR request? Does is still apply if over £10k?

                Hi,

                Today, I have received some papers back from MKDP regarding a CCA request that I made. I currently have two court claims that I am defending from original creditor Barclaycard now with MKDP.

                Account ending (9008) and Account ending (2003). Both defences have to be in by the 13th Februaury. This claim (9008), I have already applied for a 28 day extension as they did not have any documents and had to revert to original lender. They still have not sent the Assignment, Default notice or Formal Demand as I requested but I suppose they still have time until the 13th Feb?

                Can someone please cast your experienced eye over these documents and let me know how best to direct my defence as the attachment are just generic copies of terms and conditions etc with no date or signature? or is this now sufficient?

                  Barclaycard Conditions Pg 1

                  I have two further documents that I cannot upload as the file size is too large? I have separated them onto two pages but they are still too large? Any other ways I can upload them?

                  These documents are two pages of the "Barclaycard Agreement" "A copy for your reference" photocopied on one side and the other "Barclaycard Conditions of use. A copy for your records" No personal details of mine.

                        Hi,

                        MKDP have sent me a letter from Barclaycard as per the attachment above saying that this information along with, I presume a generic copy of the 'Barclaycard Conditions' and a photocopy of a 'Credit Agreement' which I also presumed is a general one with my name an old address printed on the front of the 'your right to cancel' policy. No signature or date?

                        MKDP and Barclaycard have stated that they have given me a reconstituted copy of my agreement together with a copy of the terms of my credit agreement as varied in accordance with section 82(1) of the act.

                        Does this mean I don't have a chance to defend now? Getting a bit worried as I have to get my defence in by the 13th Feb?

                          For clarification:

                          A " reconstituted" agreement must have the following elements.

                          1. Your name and address as at the inception of the agreement.
                          2. The Creditors name and address at inception.
                          3. The T's & C's at inception and closure of the account.
                          4. Any other documents mentioned in the T's & C's.
                          5. Any material amendments to the T's & C's during the life of the agreement.
                          6. A current ( not historical) of the account).

                          The document should be easily legible in all parts.

                          Signatures are not required on recons.

                              Thank you for your reply, I'm finding it a bit confusing as to what I should be looking for on the recon CCA agreement. Is it possible that you can have a quick look at the attachments that I have uploaded to check if they are correct? If they are correct what should I do as my defence is due in on the 13th Feb?

                                None of those documents appear to have your name and address on at all ?

                                Ahhh is it printed on that entirely separate page with the RIGHT TO CANCEL bit ?
