    Re: Unfair dismisal ?

The last sentence makes it clear what the Judge thought, as she clearly seems to think a final written and dismissal for not reporting were both to severe an punishment and therefore would have been unreasonable. Question is does she think the way the disciplinary was handled was fair and reasonable, i doubt she does given from what you have said about what shes said and her reaction to what you told the tribunal regarding their actions towards you. She was probably shocked as its not only disrespectful towards you and your partner, but also towards the tribunal and the judge herself, not to mention clear sign of the respondents contemptuous attitude towards the tribunal and legal process as a whole. Its like saying "hahaha i sacked you what you going to do about it now!!" whilst not realising just how seriously in the shit they are right now!

      Re: Unfair dismisal ?

I really hope your right as it has been so upsetting for me and my family. I did send an email to the tribunal service requesting that the judge take into account my preferred remedy ie reinstatement and they have told me this morning the judge has agreed to add it to the case file which i assume means she is prepared to consider my request as a possible option.

The reason for requesting reinstatement is if that happens i would possibly get back my backed dated pay which would be worth more than just compensation and then i have the option of finding another job before I leave. It also sends a clear message to the SSSC which they really cant ignore. So once all that is sorted out including disclosure scotland I will be free to move on which i intend to do ASAP which should be quite easy if all works out in that order. I really dont want to stay here now anyway but that would give me time to sort out my affairs

        Re: Unfair dismisal ?

I am still waiting to hear what the decision is of the employment tribunal Judge. It is a really difficult and torturous wait. I suppose 7 days from the tribunal is not a long time but every day seems so long waiting for my future to be decided

Still no news from the ET.
However i have just discovered that my DBS and Enhanced Disclosure contains the allegations that were made against me which is preventing me from getting alternative employment. I have raised a dispute with disclosure scotland regarding this but after talking to the DBS they said i can only dispute whats on individual updates which means i cant prevent the police from continually adding the same allegations on every update which means I will never get employment. Surely that cant be right. I also have a live complaint which the Independent police complaints commission regarding corruption of my case which obviously is upsetting the police in my home town which i assume is part of the reason why they keep including the allegations on my enhanced disclosure. The other thing is the information in my disclosure is worded in such a way ie "he did do x y and z" with no mention of it being a false allegation. Im getting to the stage where I really dont know what do next. The top police officer for my area is not returning my calls either so i dont know where to turn at this point.

                  Re: Unfair dismisal ?

Still no news from the employment tribunal.
However i had a discussion with the local Chief Inspector for my area today as part of my efforts to get the information on my DBS and Enhanced Disclosure removed. He was dismissive of his responsibility in regards removing such information and advised i should raise a dispute with the DBS and Disclosure Scotland which i have already done. However he went on to say that because the verdict was not proven in my case that still leaves a question mark over my innocence. He said that may suggest It was the investigation that was flawed rather than me being innocent of the charge a faced. I think because i have an ongoing complaint lodged with the police complaints commission in Scotland is having a negative influence on the lack of action by the police. I also think the police and other agencies are all waiting the outcome of my employment tribunal and either hoping i will go away or just accept any outcome they come up with as long as i can move on with my life.
Do any of you guys have any idea of where i go from here. A friend has said to me to contact www.factuk.org for support and assistance

                      Re: Unfair dismisal ?

I just got notification that I lost the tribunal. The judged decided dismissal was within the band of reasonable responses for not reporting my personal problems irrespective if I was the victim of assault

                        Re: Unfair dismisal ?

I've decided I need to sell my home and leave the area I have lived all my life. I think due to agencies closing ranks I have no chance of getting employment in the area I live. I also think the Sssc will move to take my registration off me. As at the last hearing or review of my case even before the panel retired to make their decision and even before they told me on the day my employer emailed me to tell me what the decision was. So the decision was agreed by dumfries council and the Sssc before I even attended the review. So I think now my case has been hopeless from the start.
