    thankyou [MENTION=65560]Sandy Ago[/MENTION] xx I am just worried as I again requested proof last week of this payment whether they have slipped something to court last minute. when i rang court they said any additional evidence they submitted had to be sent to me but you know how BC/Lowell operate! just wish amethyst had had time to tell me points she saw in their statement. I am so scared sandy... what if I get a judge who won't let me plead my case?? I have never been to court before. I am scared out my wits. Not slept for weeks worrying about this. Know I am in the right, have proved my continual demands of proof of this alleged £1 for 5 months but BC/Lowell are clever! look what they did to me... in their witness statement they attempted to prove this £1 by a pathetic... payment received from CRS dated same day as witness statement! addressed to me but first I saw it! oh well... I will have to wing it tomorrow. Just hope my nerves stay intact and I get to say all i want/need to say. Thanks Sandy for your support. Means a lot when I am so down and scared xxxx

        [MENTION=55122]debs65[/MENTION]... As Nem said, you are not going into a full size court room, just a small meeting room for you, the judge and the claimant's rep. The judge is bound to be sympathetic whilst remaining fair and impartial... both you and the claimant will be allowed to state your case so you will be heard.
        Of course, right up to the last minute, you have made it clear that you have been denied fundamental information and, as this is crucial to the case, it seems clear that there is no evidence to support the claim. Proof in civil cases is based on the balance of probabilities and it is far more likely that even if they can show you made the payment, it was for a statutory fee and not for a payment to an account... it's just too unlikely to make that single payment at such a time!
        Who said they are not attending??? If they don't turn up you will surely win by default.

            Well, Lowell is the claimant, BC is the rep so, if they are not attending, it will just be you and the judge... you and the judge have a copy of their witness statement so you will be able to argue against what they have said in that. I would love to think that they know they have probably lost this case so it's not worth them spending any more time and money on it... perhaps they hope there is a chance you won't turn up to defend!

Not partying though as they could appeal but, for now, I am going home to have a bloody good cry- the relief that 8 months of hell is over has me very emotional. Many people would have rolled over right at the beginning - you haven't, you have stuck to your guns and stood up for yourself. And it has paid off. I could not have coped without this site- how you and nem have put up with me I will never know! Court was strange. Judge looked scary and I didn't have to say a lot really. The alleged £1 was all mentioned really and he just said " you're telling the truth aren't you" as he could see how many times I had asked for proof. I said " yes sir I swear I am telling the truth" and that was basically it! Thanks again for everything amethyst- your a diamond xxxxxxxxxx ps- I won't disappear of the site - hopefully I can offer support to others in similar situations

                          Please do stay about and help others, even if its just a kind word or a bump in the confidence department it really does help, and sadly (as you've noticed) it sometimes can be so busy on here it's tough to keep up xxxx Court is scary, I know, I've been there, I don't think I said more than two words last time I was in for myself, but I was so proud of myself for getting in there and sticking up for myself...... if you hadn't of gone today it would likely have been a different outcome, we see it happen a lot..... so we really do need to encourage people to attend court, and to defend cases that can be defended - and even in the case of admissions, peeps need to fight their corner for a long term sustainable solution. Lenders and DCA's should not be able to get away with whatever they fancy just because consumers are intimidated by the court process.

                            I have been a bag of nerves about going to court- you know how ill this situation has made me. But there was no way I was going to let them walk all over me. Seeing how many people that have been affected by fictitious payments spurred me on to fight my corner. Why should dishonesty conquer honesty! The judge saw straight away I was telling the truth, pleased it was just me and the judge I have to say but it was no way as scary as I expected. I had no confidence in myself as I thought I was out of my depth but this site gave me courage and if I can offer support to anyone I will do so in a heartbeat x
