  • How to avoid to a strike out of my claim

    I submitted a claim on my own. I was a international PhD student at a British University and I had a serious issue that lead to the loss of my studentship (from my government). I do not have funds to pay a solicitor or barrister so that I am litigant in person. Because I submitt particulars of claim written by me, the defendant, ( the university) applied for strike out the claim, because of the mistakes I made regarding the legal terms and because they considered ill founded. I did know what to do, but I have received a notification from the court to fill out the form for allocation to a multi track case and to the high court and I also was asked to file proposed direction. That means that it was not strike out? I also noticed that de University made a lot of false statements on their defence, what can I do??


    Can I bring it out to the court to this point, when I have filed the allocation form? Can a represent myself on the high court?

      Yes, you can represent yourself but I would explore all avenues to get representation if at all possible.

      Without seeing your PoC and the defence and strike out application, it is difficult to make any further suggestions.

      Can you post them as far as possible removing anything which would identify you or the university. (I recognise that this may be difficult).

        Thank you for your response. Do you mean to post the defence and strike out application here ? It seems that I also submitt the claim out of the time limits

        But I would like to know if I can send a letter to the court explaining why this happened and the false statements that the University made ( I can prove it)

          Courts are increasingly strict about time limits and you would have to show "good reason" in order to get an extension of time.

          That you are a litigant in person will assist you but only so far.

          Are you seeking Judicial Review of the University's decision (limitation period 3 months)?

          How are out are you?

          Edit to add: At this stage, the court isn't interested in what you say are false statements in the defence.

            Thank you again, I am really concerned about this issue and I am from another country. I do know exactly whay judicial review is. I only received a notification from the court to fill out the proposed allocation and I am writing a document for "proposed directions" but I dont know when the judge decided if they will dismiss my claim.
            For breach of contract I am ok . The period is for six years, but not for harassment and defamation. I will try to attach the files . I really need some help-
