    Hi folks,

    I need advice ive done a very stupid thing :-( a while ago i allowed a bailiff from rossendales into my property and signed a property cease form sent of my request for paying in installments but never heard back and then i became ill and have had appointments to attend so didn't occur to me to do anything i have had a few visits while out and to be honest i was to scared to contact them today i came home to a letter saying i have until 17/11 to pay 2050 or they will force able gain entrance..now i really am scared what, if anything, can i do
    I have two youngish (11 and 8) children who would be petrified of this happening but i do not have anyway of obtaining that amount of money...Help

    ems - try not to worry too much. I know that's easily said but it's unlikely to be as bad as you fear and you're (as you know) in the right place for the best help.

    One of those who knows the territory will come along shortly and help you with a strategy to sort this. In the mean time try to chill - have a cup of tea and put your feet up. There's nothing you can do just now and there's nothing they can do either.x

        hi there the debt is for council tax and the form is a goods taken intoi control form i.e i have said if i doint pay the debt then they can come take my sofa cupboards kids wii t and virgin box ( although the virgin box doesnt actually belong to me its property of virgin) no im not a single parent but my husband works nights and my children are anxious enough that there dad isnt here during the night ( in case someoen breaks in). I know i have been really silly and burying my head in the sand but i do want to sort this im just really scared what can i do now I am not very good at speaking to people on the phone :-( i am prepeared to make payments my husband will even agree to an attachment of earnings but short of a loan which a, i doint really want and b, not sure we would get (hubby only being working a year there is no way we can get together 2050 by monday we have no family who wopould be able to help either

          The bailiff has " taken control of goods" previously known as walking possession.
          Is your husband named on the CT bills?
          It is not a good idea to take on more debt to pay this it's a vicious circle and will be hard to get out of.

          How old are your children?
          You talk of illness is it such that you could be considered a vulnerable person?
          Which bailiff company is involved?

              First things first, the bailiffs can only take certain items ... and anything belonging to ANYONE other than the named debtor should be left (ie: the children's games console and the virgin media box).
              They cannot 'break in' on a night, and (if you refused to allow them entry) would probably have to go to court for a warrant to allow them to use a locksmith anyway.
              Bailiffs cannot enter the house if there is no-one over the age of 18 in either.

                Do you just owe the 1 years Council Tax or are there other years?
                Have you confirmed with the Council exactly how much is owing?
                What items are listed on the Control of Goods Agreement - exactly as it is written?
                Do you know what fees they have applied so far?

                  i doubt i coud be classed as a vulnerable person its "only" endemetriosis which involves lots of pain tiredness and monthly injections and hospitial appointments but not anything that would make me class as a vulnerable person :-( children arent young enough to be classed as young children they are 11 and 8 and it is rossendale and no my husband isnt named on the bills thx for all the responces im looking at having my goods taken or prison arent i ?

                    no as yet there is no arrangement in place i did send of my income and expenditure form but didnt hear anything back and had no forms to make interim payments, I am aware this is my fault as i did the ostrich act and truly do intend to pay but need to get past monday and gwt something in place

                        Your children (at 11 and 8) are still not classed as adults - they are under 18 - so the bailiff would have to take this into account when s/he visited your house. They would not be able to enter the property if there was no adult present.
                        When the bailiff next turns up, you could always try to arrange an affordable payment plan (maybe write a letter explaining why you haven't been replying to the letters left after the missed visits etc... that you can hand to them)?
                        Have you got an Income/Expenditure sheet you can use to work out what you can afford to pay (weekly/monthly)?
                        Can you set up a standing order (not a direct debit) to ensure payments are kept up to date?

                        You will not be sent to prison - you are not refusing to pay!!

                          So they are chasing three separate LOs hence the £225 compliance fee (£75 x 3 = £225) and one enforcement fee of £235?

                            where is ther 2050 coming from?
                            unless ive lost it, 225+235 = 460 odd.. not 2050???

                            i came home to a letter saying i have until 17/11 to pay 2050 or they will force able gain entrance

                              I can try writing a letter and handing it to him, i almost want to go to court to try and arrange something with them the officers at my local court were really helpfull when i was trying to sort things for my mum.. I have no problem talking to people face but am scared about someone on my doorstep..what if he trues to push past me im just scared i want to sort this i really do ...would it be worth sending an email to rossendales explaining my situation ?
