    So, I have a huge problem. I have a case with Rossendales for unpaid council tax, I explained that I couldn't pay in full and couldn't afford the monthly payments they wanted me to pay. At the same time, as my personal circumstances had changed, I contacted my local council and arranged to pay £5 a week for current council tax for this current council tax year.
    The problem is now, that Rossendales will not deal with me and tell me to contact the council, which I have done. To my disbelief, the council told me to contact Rossendales as all of the council tax for 2014/2015 is being dealt with by them now. I asked why as I haven't missed a £5 payment since it was set up and they couldn't give me an answer. They did however tell me that anything that I may pay on my council tax payment card will be taken off my bill for 15/16.
    I want to pay but no one will deal with me. I live with depression and am currently caring for my husband who is awaiting to see a specialist for his ongoing health problems and we also have 3 children. I don't know what to do.

    Hi Candicevanilla, welcome to LB!
    I think the best thing I can suggest you do is to write to both Rossendales and your council explaining the situation (and cc your local MP in on the letter too). Advise them ALL that there is a dispute, and although you are willing to pay, and have offered payments, there seems to be no way to repay your debt if you are not told who you have to pay! Explain that the council are saying pay Rossendales, while Rossendales are saying you should pay the council.

    I would also (personally) stop paying the £5 a week on your payment card (as it is not being put towards THIS years CT) and instead save this money up until both the council and Rossendales agree on who you have to pay

      They cannot take payment for 15/16 the tax has not been set and doubtful in law they can

        Thank you. The last written things from the council was a readjusted bill on 3rd October where it clearly shows that I have been paying the £5 a week from 1st September as agreed. I have just had my neighbour bring me a letter of mine. It's dated 23rd October and says that they received my payment of £5 but as I should be aware by now that as of 27th July the matter is now with Rossendales! How can an agreement that was set up mid august (1st payment to be made on 1st September to allow payment card to be received) be sent to Rossendales the month before without any notice and for essentially an amount of money that was not owing yet? If you have failed to pay some council tax before can they send the remainder of the bill to bailiffs before it is even due?

          Have you received any written communications from Rossendales? It may well be headed Notice of Enforcement if you had.

          For which years is the CT debt outstanding? This may be more than one lot of CTax.

          If you go to the council, they cannot refuse payment, or that is my understanding. If it has been passed for Enforcement, it will now have incurred a £75 compliance stage fee which seems a bit tough if you have not reneged on your repayment agreement.

            I get different letters from Rossendales every other week. I moved into current property in January 2014. Rossendales say that I had2 cases with them. One for January to March 2014 and one for march to July/August, they are unsure of end date. One minute they say they are removing my goods, next that I haven't kept up with arranged payments. I have never agreed to any payments as I simply didn't have the money to pay anything at the time. Last contact with Rossendales was them stating that my cases were no longer with them. Of course, on hearing this I called the council to see if I could set up a payment agreement. I was told that the January to March 2014 amount due was with Rossendales, as we're another 2. One for march to August? And one for the remainder of this council tax year and that any payments should be made to Rossendales. I tried to talk to Rossendales again but I got no where. Simply put, I was told that I was wasting my time because they were no longer dealing with my cases.
            I want to pay. This is what is frustrating me and stressing me out. Since my husband had a bad fall his health has become increasingly worse and had to stop working altogether a couple of months ago. It is a complex problem but basically medical professionals have said that he shouldn't do anything of responsibility including looking after our young son by himself and that he shouldn't be left alone for long periods of time by himself. That in itself is stressful and now we are slowly getting back on our feet financially this all just feels like a kick in the teeth.

              Your husband sounds as though he is clearly vulnerable. Are you in sufficient health with your depression to oversee the CTax issues, or are you on medication / under a doctor or consultant?

              If you feel you are vulnerable, you should not only contact your councillor to explain the issue, but contact the Welfare Department of Rossendales and inform them of the problem. Try to keep everything in writing rather than doing things over the telephone. Text / email is fine.

                Health wise, I get passed from one mental health worker to another. I'm not currently on medication as have been able to manage my depression but this is making that harder.
                Every time I have ever written to either Rossendales or the council they claim that they never receive them.
                I would ideally like to continue paying the £5 a week for the rest of the current ct year and £10-£15 a week for the money owing. I know that I can afford that and be able to keep on paying that amount until it is cleared but I guess that just isn't going to happen I just want and need to get this sorted as quickly as I can before it really gets to me.

                  Contact your councillor and contact Rossendales Welfare Department. They will be able to help.

                        Payments to who? I normally pay all my bills weekly, at the post office by using my payment cards.

                            If your local MP is involved, you are more likely to be taken seriously (in my opinion). They seem to be able to push harder for things to happen - and tend to get faster results :tinysmile_twink_t2:

                              That sounds correct. Most (all?) councils treat each tax year, as a separate debt. This can be very confusing for the debtor as bailiff communications are often unclear which debt they relate to.

                              Please forgive my ignorance but what will contacting my councillor do?
                              Many councillors are great - they do their best to help people in their ward and can pick up the phone and be listened to by the staff on the council tax office. Well worth trying.

                              I think you should put in a formal complaint to your council about the confusing communications you have been receiving.. You will probably be able to do this through their website or by email. You need to be clear in this complaint what you are asking for. You should request that the council tax debts for both 2013/4 and 2014/5 are recalled from the bailiff, you should ask for the bailiffs charges to be removed and you should ask for the council to accept direct deductions from your benefits (I am assuming that you are your husband are in receipt of benefits?) to repay the arrears. You reason for requesting this is your husband's disability and your own mental health problems - you should ask that you are treated as vulnerable clients - use that exact phrase.
