hi everyone
I am going through a sticky mess at the moment with equita.
they have told me that they want £6500 a month for my debt and want their first installment next week.
I am a sole trader and i would be lucky to find this extra money as well as all my other bills .
Any advice anyone

Whats the total outstanding, its it all NNDR ( business rates ). How many years is it for, and how much per year for your NNDR

hi crazy council the rates are 21000 per year and i owe 16000 for part of the year.this is from 2013/2014
Equita have said they want this debt cleared by the end of the year.
I think there will be some court costs on that and probably now some bailiff costs.

You need to make them some offers yourself that you can afford. D|o this formaly, and they may struggle to take further action unless you fail to pay.

These offers depend on you maintaining your current NNDRx. And a few other circumstances. All council have guidence to ensure they do not push businesses that are running, over the edge.

Explain to them how you simply can not afford what they have asked, but be truthful about what you can afford. They may ask you to prove it

Suggested offeres

1. We offer to continue paying our currnet NNDR liability plus a payment of £ *** per month to clear our debts. We are simply unable to afford to pay what you requested per month and this may have a disruptive affect on our business. If our income increases, we will pay it off sooner. Please consider this before taking any action that will further increase our debts.

Some tips for you

Council like NNDR/CT paid up before the new finacial year starts, but, are expected to be reasonable with any offer from exsiting businesses that would clear the debt within 2 years.

If you employ staff, mention this in the letter

You will have to deal with equita, BUT, send a copy , and get acknoledgment from the head of revenues at your council ( google for there email address ).

With you current NNDR being 21k pa, and your prior debt being 16k.

If you can afford it, offer and extra £1k per month ( over 16 months ).
Or 2k per month over 8 months. if its affordable
or 3.2k per month over 5 months ( paying it before next april )

Just make sure 1. Its affordable, 2. its not a lot less than you can really afford.

Hi anne

Expect equita to say no or try make you pay more than you can afford so they can get charges, but stand your ground. They may stillgo for a liability order ( cost you approx £ 100 ) , but will struggle to take any further action like baillifs or worse, Do everything with them by email so its recorded, and copy the head of revenues in to any disputes... even if they say only communicate with them.

Is this a letter you have received from Equita? If so how was it delivered? Is this the first you have had from them? Is the letter headed Notice of Enforcement?
