      Hi [MENTION=9906]seduraed[/MENTION] i didnt see your other post about the himo before.

      Do you live in the house, if so, you can be classed as landlord in residence, letting rooms ( legaly lodgers if i remember correctly ), Smoke alarms are a must but i think you dont have to comply to most of the other HIMO regs. I will check tomorrow if its still the same.

          Because if you can class is not as a himo, maybe you could argue out the charge that the council have imposed, by putting the blame back on them for not classifying it properly.

            thnks you for teh support no this is definetly an hmo but they re trying to but the highest level of regulation on . I know there is political pressure toget me out .

              Hi, there is not a straight line for them to class it as a himo, and if you can question that, it would make challanging them easyer.

              If you fully discount your own family members, how many separate families live there ( 2 cuplles or 2 singe people are still only 2 familys ).

              The council will insist its a himo, ask them to document why.

              just so you know

              1. I have owned my own himo for about 20 years
              2. I dealt with a good few himos between 1996-2003
              3. I had to argue out classification with my local council legal team in 2005 to clear up this point.

              I also have a lot of experience of fighting within council systems.

              If you can legal class it as not a himo ( i suspect you may be able to ), then deal with this a bit more offensively.

              In this case, both teh 151 officer and CEO, would need contacting

              I would put the responcability on them,

              If yuo think you can take this route, let me know and i will pen part of the letter for you,

                Right the set up is as follows .
                Upstairs on romanian couple and their cousin
                Downstairs myself and my wife
                in annexe 30 yards from main house Couple who rent two rooms.
                Two small rooms too small to use as bedrooms (less than 50 sq .ft.).
                All cooking in very large modern kitchen.

                  just changing the subgect slightly here :sorry: but is there anything in the regulations saying that a bedroom has to be a specific size now? My lads room is smaller than 50 sq. ft ... and we get charged bedroom tax because we have a 'spare bedroom' in their eyes :tinysmile_hmm_t2:

                    Is separate council tax paid on the annex and does it have its own washing and cooking and toilet facilities, if so, the romainans could be classd as one family, you the other...

                    If its all called under the same CT, then its harder to argue

                    Ther rooms they are saying are to small, are these occupied by teh romanians

                      The annexe has it's own shower room but no cooking facilities
                      The small rooms I is empty and the other the tenant is an occasional visitor.
                      I can't use then having been served with prohibition orders as they are automatically a class 1 hazard

                        that makes more sense, and its a HIMo without doubt. Probebly no way around this, but, there may well be funding available from the local council to help convert your rooms/home into a himo. I know most of them used to run the scheems, i will look at the weekend what fundings about for this.

                          Honey, we all know the clichés about ‘darkest before the dawn’ etc. Now I have no knowledge about the legal situation but I do know what it is like to have one great big problem which is insurmountable. It is S***e and it seems to have no edges, top or bottom. All you need is one more thing as simple as the toast falling on the buttered side and it will be enough to bring the whole stinking, steaming pile down on your head. You are not exaggerating or taking things too seriously; you are in the thick of it for sure and my heart goes out to you. However…… You already have achieved so very much. You take care of your wife, son and two doggies. More than many of us could take on. The greatest compliment I ever had is when someone said ‘can you help me’. Out of all the people in the world they chose me when they hit crisis point and in a weird way I was flattered. You make people’s lives worth living. Don’t you realise how awesome that is! Oh tiring, wearing and often frustrating but one hell of a thing to do.
                          Before you do anything else have a chat with your GP. God almighty it is not as if you are a weakling –Mother Theresa couldn’t put up with all this without some sort of medical help! If your GP is no good then ask to see another one. This, for once, is about YOU.
                          Forget trying to solve the whole thing at once because that is going to finish you off! This is not a bulldozer job, it requires a small shovel. Chip away at the issues and try solving them bit by bit. Start at the top and work your way down.
                          As I said, you do something amazing. It is a selfless task but a hard one. As a result many of us on here, myself included, admire you and want to help. (Just so we can pretend to be as valued as you!) Please keep on asking questions- there are so many bright, intelligent and knowledgeable people on here who will steer you in the right direction. AND RANT, RANT, RANT to your big hearts content. Not only will you get a chance to get stuff off your chest, you will get advice and this thread will help so many others in the same situation.
                          The really bad news is if anything every happens to me I will want to move in with you because I doubt my Hubby will be much good at looking after me! :tinysmile_kiss_t4:

                            Not been a good week . Had the old ambulance we were using as a wheelchair accessible vehicle catch fire and get completely destroyed. The car was recovered by the highways agency, so I rang the recovery company to be told that as the car had been separated from us the onward travel insurance was no longer valid . This was with a specialist insurer for disabled drivers and passengers . So we are taken by ambulance to Stafford general hospital . There i discover that although they will reimburse for car hire i have to find the cost first and particularly the deposit . This has caused a problem as we have no credit cards and not enough in the bank . So eventually we got home thanks to the kindness of friends.

                            Shame on you FISH.

                              How crazily illogical is that? The highways agency have to do that. Sorry to hear of your pants day. A letter of complaint needs writing to the insurance company me thinks. They have a duty to point out unusual or onerous contract terms.
