  • Dla problem

    Another problem !!

    to cut a long story short my daughter (9) had her dla taken away and we appealed this went on for 16 months and the upper tribunal found in our favour

    Whilst this was on going dla have archived her file and they say we may have to send all the paperwork in again
    because we told tax credits about the appeals we lost the dla element of tax credits and they said we owed them around 2k
    tax credits won't sort the money out until dla send them the paperwork which they can't do as her file has been archived
    also my son has just been awarded higher rate dla with middle care component and tax credits won't put that element on until the 2k is paid off but once the dla sort there side out tax credits will owe us that 2k

    so far they owe us around 8k which is now going up at around £800 a month

    any ideas on how we can get this sorted as we offered to fax the judges decision over but they won't accept that only what dla tell them so we are going round and round in circles

    Chaos reigns at DWP!

    Have you tried sending DWP a copy of the tribunals decision notice that was given to you?
    Tribunal representatives often do this as good practice because of the frequent delays caused by DWP not receiving or distributing the tribunals decisions.

      They won't accept our copy as they archived her file and they said if they can't un-archive her file we have to send in everything again

        DWP claiming they can't access their archives ! If they were chasing you for an overpayment or alleged fraud I bet they could "un archive"

        This is unacceptable by DWP and complaints need to be made at highest level.
        Involve your MP, and let DWP know you are.

          They are already taking an overpayment from tax credits all because we told them that the dla was going to appeal
          yet once they sort this out they will have to repay the overpayment

          You really couldn't make this up lol

              here's the DWP complaints procedure ... I agree with [MENTION=39710]des8[/MENTION] ... involve your local MP!!

                  Quick update

                  sent email off Wednesday (no reply so far)

                  Thursday
                  lady from dla phoned up the other half and asked for the judges letter which we faxed over
                  she also said she would ring and speak to tax credits

                  Friday
                  looks like the dla element got paid as money went from £90 upto £170

                  now just waiting to find out about weather the file has been recalled and to hear when we will get the 17 months back payment from them both

                      I will as its around 8k were owed at the moment and possible compensation on top
