CCJ FOR HUBANDS SMALL LIMITED BUSINESS cOMING TO OUR HOME

  • CCJ FOR HUBANDS SMALL LIMITED BUSINESS cOMING TO OUR HOME

    Hi everybody
    I have a question if any body can help.
    This is more a business question.
    Two weeks ago,
    my husband recieved a CCJ for his construction business
    we use our accountant address as registered address
    As his office has been knocked down.
    I work part time at home & our registered postal address is our house!
    This where the Ccj & court papers arrived.

    We previously asked the company FD if he will hold off for a 2 weeks as we had,
    We explained

    We had A nightmare project
    due to delays & We lost the men who agreed to do the project for
    A lump sum & had received more than half of the original budget.
    My husband had to do this large project himself with our son.
    The Delays were due to having to work from a tower scaffold as they dropped the scaffold
    Also missed 3 cutting schedules and had to cut onsite,
    I Believe the delays were not the fault of our company
    Then £4000.00 worth of insulation was stolen from site.
    From site We called The Solicitors Higgins at Lloyds chambers
    They informed us if we don't pay the bailiffs will be calling Tomorrow October
    My question is can we claim anything back from this
    And can they come to our house!

    Dont let the bailiffs in they need an order to seize. How much do you owe?. Have you contacted the police regarding the stolen materials?. I'm sorry to hear about your problems.

      Did he receive court papers or a document entitled 'general order of judgment' or something similar? If he received court papers, he should acknowledge service in 14 days (5 extra days are allowed for service) so time is tight. :clock:

      Court papers mean the creditor will want to obtain a CCJ but no CCJ exists yet. If it's an order of judgment, it means a CCJ has already been obtained.

      Presumably this is the company's registered office too, in which case that's the place where the papers should be sent. Is this business a limited company?

      In order to send bailiffs they would have had to obtain judgment first, rather than just sending court papers. Can you clarify whether this is the case to start with?

      As for the bailiffs, provided there is, in fact, a CCJ, they could call, but you don't have to let them in. Make sure you don't leave any doors unlocked just in case. They can't force their way in.

          Knowing the people you have been in touch with they will transfer the Judgment to the High Court for enforcement. Before any Enforcement Agent can call you should receive a Notice of Enforcement giving 7 clear days notice of attendance at your premises should you fail to get in touch to pay or make an arrangement to pay. Costs of this depends on whether it will be the County Court Bailiff or a High Court Enforcement Agent who attends but would suspect the latter.

            Hi there,
            Thanks for the advice its we owe £3300
            The insulation £4000 the project delays -£5000 +
            A judgment has been obtained we have offered to pay the supplier three monthly installments.
            We have a crime number the insurance man
            I'm hoping we can recover some back from the delays the QS has gone very quiet in us.
            ( not unusual these days) 👍

                Hi there,
                I'm Just an updating the enforcement offers put a letter in asking for contact
                even though We made an offer which was accepted today with an email
                today with dear sirs we would like to accept .......... offer please make arrangements
                With the enforcement officers.
                The to the visit the enforcement officer called my husband to say they would be calling
                He said he wasn't at home advised him this easht the registered office
                but our house we are waiting for him to call tomorrow for the first part of the agreed payment

                And we didn't get paid by another contractor we were taken from the list.
                So we can't pay
