    It is up to the court to decide based on the information provided. Having a good argument to dispute the claim and a draft defence should help, the court won't want to waste time setting aside a judgment that can be easily won by the claimant if they re-issue. With regards to the claim forms, if you have any reason why you didn't received them on time, or why you were not able to deal with them at the time, that should also come into play.

      Thanks for your help, so instead of saying that I did not think they were from the court, I should think of a reason why I never sent them off in time?
      i do believe when I called them there were 2 letters sent one was about the 7 July and 20 th August, not to sure on these dates

        The letters are not easy to understand, also really you do need legal advise on how to deal with these, I like many others do not know the law, we do not deal with courts, or there paper work,

        its a a god send there are forums like this

            I have found out what it is on line, I do owe money, but the amounts the gave me, I have no idea???? As I have not credit agreement and they have not sent me it, so I do not know how I would ever really know what I do really owe?
            I have since kept there letters, they only have a few third , my date of birth, the company who took over debt Cabot, my last credit paid? Which I asked how was this payment made?? They never got back to me. Thanks again

                I have just found this on line, advice on the CCJ process, I was thinking of using this? What do you think?
                with this in mind here is a quick guide on what you should do if you recieved county court paperwork.
                the first thing to make sure is that the paper work you recieved is actually from the court and not just a threat of action. Letters from debt collectors can be carefully worded and made to look like they are taking you to court action, when in reality they are just trying to scare you into making extra payments to them.
                before you receive any court paperwork, the original creditor must of issued a default notice, . If you receive court forms coloured pale blue with a court crest on top, your creditor can apply for CCJ.


                well my letter was not pale blue did not have a crest so I ignored it?

                And this his is what I'm thinking of printing out to show that I did read on line, and the letters I got did not look like ogffical court papers, so that is my defence for not responding??? What do you think?

                  I also wanted to add, over the years I have had many different company's send me threatening letters, of sending baliffs on my doorstep, nothing ever come of it???
